Договір як основний регулятор перевезення небезпечних вантажів

Abstract

Розглянуто регулятивну роль договору у відносинах, що пов’язані з перевезенням небезпечних вантажів. Надано характеристику договору перевезення вантажів, а також договору перевезення небезпечних вантажів як виду договору перевезення вантажів з особливим правовим режимом, визначено специфічні моменти, які повинен містити договір перевезення небезпечних вантажів. Визначено права та обов’язки вантажовідправника, вантажоодержувача, перевізника небезпечних вантажів. Підкреслено, що саме договір є основним регулятором перевезень небезпечних вантажів, оскільки, внаслідок особливого характеру таких перевезень, безпосередньо договір передбачає/повинен передбачати умови забезпечення збереження вантажу, безпеки перевезення. Дотримання умов договору дозволить своєчасно доставити такі вантажі до місця призначення, захистити учасників дорожнього руху, учасників договору та третіх осіб, які не беруть участі в укладенні та виконанні договору перевезення небезпечних вантажів, а також сам вантаж, транспортний засіб та навколишнє середовище від надмірної небезпеки.

In this article we are talking about the regulatory role of the contract relating to the carriage of dangerous goods. The characteristic of the contract of carriage of goods, including a contract of carriage of dangerous goods as a form of a contract of carriage with a special legal regime that determines the specific points that must contain the carriage of dangerous goods. We consider the rights and obligations of the shipper, the consignee, the carrier of dangerous goods. The authors concluded that this agreement is a major regulator of the transport of dangerous goods, since, due to the special nature of such traffic directly contract provides / should provide conditions for securing cargo transport safety. That compliance with the terms of the contract allow timely deliver such goods to their destination, protect road users, parties to the contract and the third parties who are not involved in the negotiation and execution of the contract of carriage of dangerous goods, as well as the goods themselves, the vehicle and the environment from the excessive dangers. It should be noted that the contract of carriage of dangerous goods is not an independent contract for the Civil Code of Ukraine, but only a certain Art. 909 CC of Ukraine as a kind of general contract of carriage of goods. In this regard, a contract of carriage of dangerous goods covered by the Civil Code of Ukraine, and to it are required general contract of carriage of goods with the specifications defined by the Law of Ukraine «On dangerous goods» and other normative legal acts related to the regulation of relations in the transport of dangerous goods. The author proposes to allocate the contract of carriage of dangerous goods from the general contract of carriage of goods and secure in the norms of civil legislation in the form of a separate contract of carriage with a special legal regime, and to restrict the principle of freedom of contract in relations involving the transport of dangerous goods, in order to ensure the public interest, rights and interests of third parties. However, it should be understood that the characteristics of the legal regime of property which stands in the contract of carriage as cargo determines the specific features and influences its content, which is significantly influenced by the imperatives to secure the public interest (eg, environmental security life and health).

Рассмотрена регулятивная роль договора в отношениях, связанных с перевозкой опасных грузов. Дана характеристика договора перевозки грузов, в том числе договора перевозки опасных грузов как вида договора перевозки грузов с особым правовым режимом, определяются специфические моменты, которые должен содержать договор перевозки опасных грузов. Определены права и обязанности грузоотправителя, грузополучателя, перевозчика опасных грузов. Подчеркнуто, что именно договор является основным регулятором перевозок опасных грузов, поскольку, вследствие особого характера таких перевозок, непосредственно договор предусматривает/должен предусматривать условия обеспечения сохранности груза, безопасности перевозок. Именно соблюдение условий договора позволит своевременно доставить такие грузы к месту назначения, защитить участников дорожного движения, участников договора и третьих лиц, которые не принимают участия в заключении и исполнении договора перевозки опасных грузов, а также сам груз, транспортное средство и окружающую среду от чрезмерной опасности.
