Сучасний стан цивільно-правового регулювання надання психологічних і психотерапевтичних послуг в Україні

Abstract

Проаналізовано сучасний стан цивільно-правового регулювання надання психологічних і психотерапевтичних послуг в Україні. Доведено, що ключовим питання у правовому забезпеченні цієї сфери суспільного життя мають стати розробка та прийняття відповідного закону, в якому було б вирішено питання надання психологічних і психотерапевтичних послуг населенню.The article considers the current state of civil regulation of providing psychological and psychotherapeutic services in Ukraine. It is noted that there are a lot of laws and regulations in Ukraine that regulate some or other aspects of their provision and mostly from the position of social security law and also functioning of a psychological service in the education sector. It is stated that the Article 49 of the Constitution of Ukraine provides for everyone the right to health protection, medical care, and medical insurance. Psychological services provision relates to the health protection in a broad sense and is aimed at securing this constitutional provision. Provisions of a set of statutory instruments related to the regulation of this sphere of life are considered: Civil Code of Ukraine, Code of Civil Protection of Ukraine, Laws of Ukraine “On Education”, “On Protection of Childhood”, “On Prevention of Domestic Violence”, “On Combating the Spread of Diseases Caused by the Human Immunodeficiency Virus (HIV) and on Legal and Social Protection of People Living with HIV” and other. It is proved that today Ukraine has a number of subordinate regulations that regulate the issue of providing psychological and psychotherapeutic services. Unfortunately, these issues are not solved fully at the level of laws, and existent provisions are perfunctory and undetailed. The author considers that the mentioned regulations mostly belong to the legislation on social protection or pertain to the legal regulation in the field of education. Psychological and psychotherapeutic services are unfortunately not considered today as an independent institute of the civil law of Ukraine, relations concerning the conclusion, execution and other features of an agreement on providing psychological (psychotherapeutic) services. It is proved that a key issue in the legal providing of this sphere of social life should be the development and adoption of an appropriate law that would solve the issue of providing psychological and psychotherapeutic services to the population.Проанализировано современное состояние гражданско-правового регулирования предоставления психологических и психотерапевтических услуг в Украине. Доказано, что ключевым вопросом в правовом обеспечении этой сферы общественной жизни должна стать разработка и принятие соответствующего закона, в котором были бы решены вопросы предоставления психологических и психотерапевтических услуг населению.
