dc.description.abstractРозглянуто проблему визначення правосуб’єктності учасників освітніх відносин. Обґрунтовано необхідність застосування до освітніх відносин вимог цивільно-правової суб’єктності, оспорено оцінку учасників освітніх відносин як суб’єктів самостійної галузі права – освітнього права. Стверджується, що участь в освітніх відносинах навчальних закладів та осіб, які в цих закладах навчаються, здійснюється через категорію «особа» («юридична особа» та «фізична особа» відповідно).uk_UK.UTF8
dc.description.abstractThe problem of determination of legal capacity of participants of educational legal relations is considered. The necessity of applying to the educational relations the demands of civil subjectness is grounded. The characterization of the participants of educational relations as separate legal subjects is disputed. In particular, it is indicated to groundlessness of the point of view in accordance of which the educational institutions and persons being educated are considered as subjects of the public relations. The participation of the educational institutions as well as the persons being educated there in the educational relations is performed by means of the «person» category («the legal person» and «the individual person» accordingly). The possibility of participation the individuals in the educational relations is determined by civil legal capacity. The volume of the legal capacity of the educated persons depends on reaching of the certain age as well as undergoing previous educational qualification. It is indicated to the principal impossibility of limitation of the educational capacity of the persons being taught. The structural scheme of the educational relations as the tripartite ones (the educational institution, the teaching staff, the persons being educated) is criticizing. The educational services are provided by the teaching staff not in its own name but in the name of the educational institution that indicates to two-element structure of such legal relation.en

Обоснована необходимость применения к образовательным отношениям требований гражданско-правовой субъектности, оспорена оценка участников образовательных отношений как субъектов самостоятельной отрасли права – образовательного права. Утверждается, что участие в образовательных отношениях учебных заведений и лиц, обучающихся в этих заведениях, осуществляется посредством категории «лицо» («юридическое лицо» и «физическое лицо» соответственно).ru
