Шляхи вдосконалення адміністративно-правових засад діяльності органів місцевого самоврядування в умовах децентралізації влади в Україні

Abstract

У статті охарактеризовано проблеми адміністративно-правового регулювання діяльності органів місцевого самоврядування в Україні та визначено напрями його вдосконалення в умовах децентралізації влади в Україні. Зазначено, що метою сучасного реформування місцевого самоврядування має стати забезпечення його здатності самостійно вирішувати питання місцевого значення власним коштом, тобто територіальні громади мають бути наділені більшими ресурсами, внутрішніми резервами для виконання завдань та функцій, покладених на них чинним законодавством щодо вирішення питань місцевого значення.The problems of administrative-legal regulation of the local self-government bodies’ activity in Ukraine are described and the directions of its improvement in the conditions of power’s decentralization in Ukraine are determined in the article. It is noted that the purpose of modern reform of local self-government should be to ensure its ability to independently resolve local issues at its own expense, that is, territorial communities should be endowed with greater resources, internal reserves to fulfill the tasks and functions assigned to them by the current legislation to address local issues. It is proved that in order to increase the efficiency of work of local authorities it is necessary to carry out a reform of the administrative-territorial structure of the state. Within decentralization, a balance must be struck between local authorities, reduced number of officials and multifaceted governance, and revised government structure at the regional level. It has been found out that the component of the reform of power in Ukraine is the division of powers between local self-government bodies and local executive bodies, as well as between local self-governments at different levels. It is considered necessary to transfer the basic powers of local state administrations to local self-government bodies, to the level closest to the people, and to the executive power to leave only the right of control and supervision of legality. In order to achieve the goal of establishing a universal, self-sufficient local government in accordance with international standards, it is also necessary to expand the powers of local self-government on the one hand, and to reduce the number of powers delegated to them by the state. It is emphasized that the state should promote the development of local self-government by delegating to it all the powers in all spheres of organization of human life with the simultaneous transfer of financial resources in the form of own income, which will allow to expand the financial base of local self-government bodies and effectively carry out local policies on the implementation of local policies assigned to local government by the legislation of Ukraine.В статье охарактеризованы проблемы административно-правового регулирования деятельности органов местного самоуправления в Украине и определены направления его усовершенствования в условиях децентрализации власти в Украине. Отмечено, что целью современного реформирования местного самоуправления должно стать обеспечение его способности самостоятельно решать вопросы местного значения за свой счет, то есть территориальные общины должны быть наделены большими ресурсами, внутренними резервами для выполнения задач и функций, возложенных на них действующим законодательством по решению вопросов местного значения.
