Реалізація основних засад (принципів) кримінального провадження в слідчих (розшукових) діях, що обмежують недоторканність житла чи іншого володіння особи

Abstract

Здійснено аналіз змісту основних засад кримінального провадження та визначено особливості їх реалізації в слідчих (розшукових) діях, що обмежують недоторканність житла чи іншого володіння особи. Наголошено, що верховенство права реалізується в кримінальному провадженні шляхом забезпечення захисту прав і свобод учасників кримінального провадження, тим самим будучи гарантією реалізації конституційно закріплених прав і свобод людини і громадянина. Зазначено, що в слідчих (розшукових) діях, що обмежують недоторканність житла чи іншого володіння особи, також реалізуються такі основні принципи (засади) кримінального провадження як недоторканність житла чи іншого володіння особи, невтручання у приватне життя та недоторканність права власності.

The article analyzes the scientific and regulatory sources that regulate issues related to the implementation of the principles of criminal proceedings. It was found that investigative (search) actions are the main means of proof, a tool of cognitive activity in the investigation of criminal offenses. It has been established that investigative (search) actions that restrict the inviolability of a person’s home or other property are procedural actions that restrict constitutional rights, and therefore must be regulated by law, which clearly and clearly defines the scope of powers granted to competent authorities to ensure citizens the opportunity to protect themselves from the arbitrariness of the investigation. The legislative definition of investigative (investigative) action is imperfect and does not fully reflect its essence as a means of obtaining evidence during the pre-trial investigation. It is emphasized that the rule of law is realized in criminal proceedings by ensuring the protection of the rights and freedoms of participants in criminal proceedings, thus being a guarantee of the realization of constitutionally enshrined human and civil rights and freedoms. It is noted that in the investigative (search) actions that limit the inviolability of housing or other property of a person, also implement such basic principles (principles) of criminal proceedings as inviolability of housing or other property of a person, privacy and inviolability of property rights.

Осуществлен анализ содержания основных принципов уголовного производства и определены особенности их реализации в следственных (розыскных) действиях, ограничивающих неприкосновенность жилья или иного владения личности. Отмечено, что верховенство права реализуется в уголовном производстве путем обеспечения защиты прав и свобод участников уголовного производства, тем самым являясь гарантией реализации конституционно закрепленные права и свободы человека и гражданина.
