Житлові права дітей

Abstract

Проаналізовано сучасні підходи до розуміння змісту поняття «дитина». Встановлено, що право на житло є одним із основних майнових прав дитини, які є соціально-економічним базисом розвитку дитини. Зроблено висновок, що право на житло у дитини виникає з моменту народження, але здійснювати це право вона може лише під час настання у неї повної цивільної дієздатності. Визначено поняття житлових прав дитини та розглянуто їх зміст.

The theoretical basis of children’s housing rights is examined in the article. It is defined, that the housing law is a subjective civil law which is both material and obligatory right, which regulates a certain lodgment utilization. It is emphasized that the domestic legal system does not establish children’s housing right, but only set a right for a place of living definition, property and sanitary-hygienic living conditions. It is proved that is a present legal system’s disadvantage, as a housing right is one of the principal social-economic human rights while children’s rights are included in this section if rights. Housing law is characterized as a system of rights, connected with a person’s in need of a placement, lodging getting, using and managing. The object of the article is a housing law notion and the system of children’s housing rights definition, and new propositions in the sphere of housing legislation formation. The methodological basis of the dissertation is a set of general scientific and special-juridical methods of scientific research. The conceptual apparatus is deepened with the help of logical-semantic method and the method of converging from the abstract to the specific. Comparative-juridical method has allowed to research the peculiarity of children’s housing law. The conclusion is made that children’s housing law should include children’s right to getting a lodgment (as a property or into utilization); children’s right to be recognized as one in need of a placement; children’s right to common habitation with parents; children’s right to be protected from the legal action which rob of a placement or worsen living conditions; children’s right to lodgment conservation; children’s right to house protection; children’s right to safe housing etc. The volume of the housing rights depends on the children’s social status. Namely, one can single out housing rights of a child, brought up in a family or without parents.

Проанализированы современные подходы к пониманию содержания понятия «ребёнок». Установлено, что право на жильё является одним из основных имущественных прав ребёнка, которые являются социально-экономическим базисом развития ребёнка. Сделан вывод, что право на жильё у ребёнка возникает с момента рождения, но осуществлять это право она может только при наступлении у него полной гражданской дееспособности. Определено понятие жилищных прав ребёнка и рассмотрено их содержание.
