Поняття та особливості механізму забезпечення права на захист честі, гідності та ділової репутації працівників ОВС України

Abstract

На основі аналізу чинного законодавства та наукових позицій визначено поняття механізму забезпечення права на честь, гідність та ділову репутацію працівників органів внутрішніх справ України. Досліджено елементи вказаного механізму та особливості його функціонування.

National and international practice clearly showed that police officers need to protect their rights and freedoms, including the rights to the honor, dignity and business reputation. Necessary condition is creating an effective mechanism to ensure the right to protection of honor, dignity and business reputation of the police officers of Ukraine. The main aim of the article is the definition and characteristics mechanism of the right to honor, dignity and business reputation of police officers and research elements of such a mechanism. We must take into account at least two major features, exploring the specified mechanism to ensure the right to protection of honor, dignity and business reputation of the police officers of Ukraine. Firstly, it is a special legal status of the media rights. Secondly, it is the special nature of rights protection. The mechanism of the right to honor, dignity and business reputation of the police officers of Ukraine should not lead to the narrow sectorial focus. That realization of the right to protect these rights should be provided by the current constitutional, criminal, administrative, civil, labor and other legislation. The ensuring of rights is necessary to understand the implementation, security and protection of such rights. Guarantees of these rights recognized in the departmental regulations and special articles substantive and procedural law. Institutional guarantees given mechanism with its feature of using departmental structures (management of internal security and legal departments), and only if they are not work appealing to the general public institutions guaranteeing rights and freedoms. Specificity of the right to honor, dignity and business reputation is that it is not tangible personal law, the violation of which indirectly causes detriment police of Ukraine in general, and therefore the state because police of Ukraine - a federal executive authority. It follows that the state is the primary duty and responsibility to ensure the specified mechanism. The mechanism of the right to honor, dignity and business reputation of the police officers of Ukraine should be real, effective, and efficient. In conclusion, we believe that the mechanism of the right to protection of honor, dignity and business reputation of the police officers of Ukraine is clearly defined by law system of legal guarantees of the right to honor, dignity and business reputation of police officers Ukraine, and if necessary protection and these rights by competent state agencies.

На основе анализа действующего законодательства и научных позиций определено понятие механизма обеспечения права на честь, достоинство и деловую репутацию работников органов внутренних дел Украины. Исследованы элементы указанного механизма и особенности его функционирования.
