Характеристика організаційно-штатної структури Служби безпеки України як суб’єкта захисту державного суверенітету та територіальної цілісності

Abstract

У статті проаналізовано нормативно-правові акти, які закріплюють організаційно-штатну структуру Служби безпеки України. На підставі чого зазначено, що організаційно-штатна структура Служби безпеки України дозволяє визначити цей орган як суб’єкта захисту державного суверенітету та територіальної цілісності. Особливо зважаючи на той факт, що в структурі безпосередньо існують підрозділи які забезпечують захист державного суверенітету та територіальної цілісності та інші підрозділи, що сприяють роботі останніх.

The article analyzes the regulatory and legal acts that establish the organizational and staff structure of the Security Service of Ukraine. On the basis of which it is stated that the organizational and staff structure of the Security Service of Ukraine allows defining this body as a subject of protection of state sovereignty and territorial integrity. Especially taking into account the fact that the structure directly includes units that ensure the protection of state sovereignty and territorial integrity and other units that contribute to the work of the latter. As a result, the author formulated a number of features that characterize the latter: – a dual approach to defining such a structure, which allows defining it in: a broad sense as a collection of all subdivisions of the Security Service of Ukraine; narrow − such a structure includes only those structural units that carry out the protection of state sovereignty and territorial integrity (units of military counterintelligence, counterintelligence, protection of national statehood, counterintelligence protection of state interests in the field of information security, fight against terrorism, and protection of participants in criminal proceedings and law enforcement officers bodies, pre-trial investigation, protection of state secrets, Anti-terrorist Center under the Security Service of Ukraine); – unprecedented legislative regulation of the organizational and staff structure of the Security Service of Ukraine, with the possibility of its operational change, during a special period that ensures the stability of the latter; – this is a certain model, which is based mainly on vertical connections, and therefore, in this model, the vertical construction of the structural units of the Security Service of Ukraine according to the profiles of the main areas of activity, where the priority is the protection of state sovereignty and territorial integrity, prevails in this model; – establishment of vertical and horizontal connections, on the basis of which stable connections between structural units arise and develop, which ensures the unified work of the Security Service of Ukraine in the field of defense of state sovereignty and territorial integrity; – the organizational structure of the Security Service of Ukraine goes against the principle of territoriality, which is related to the administrativeterritorial division of the country, instead, there are other structural subdivisions «outside the territorial division».

В статье проанализированы нормативно-правовые акты, закрепляющие организационно-штатную структуру Службы безопасности Украины. На основании чего указано, что организационно штатная структура Службы безопасности Украины позволяет определить этот орган как субъекта защиты государственного суверенитета и территориальной целостности. Особенно учитывая тот факт, что в структуре непосредственно существуют подразделения, обеспечивающие защиту государственного суверенитета и территориальной целостности и другие подразделения, способствующие работе последних.
