Місце норм адміністративного права в системі правових засад діяльності Національної гвардії України як суб’єкта правоохоронної діяльності

Abstract

Встановлено коло нормативно-правових актів, які спрямовані на регулювання діяльності Національної гвардії України. Констатовано, що в системі правових засад регулювання діяльності Національної гвардії України ключове місце належить нормам адміністративної галузі права, адже саме за їх допомогою: а) визначається адміністративно-правовий статус даного відомства саме як суб’єкта, що реалізує правоохоронну функцію держави (зокрема: мету, завдання, функції, повноваження, компетенцію, тощо); б) розкриваються адміністративно-правові форми діяльності Національної гвардії України у досліджуваному напрямку; в) окреслюють гарантії діяльності; г) встановлюється порядок взаємодії Національної гвардії України з іншими правоохоронними органами.

Attention is focused on the fact that legal principles are usually interpreted as: first, a systematic set of normative legal acts of different legal force that create legal conditions for the work of any department; secondly, as a set of principles that underlie the implementation of a certain activity. It was noted that the system of legal foundations of the National Guard of Ukraine is represented by a large number of normative legal acts of different legal force. Thus, the Constitution of Ukraine and international normative acts determine the main areas of activity of the National Guard as a representative of the state performing law enforcement functions, including by designating basic human rights and freedoms as objects of legal protection. In turn, legislative and by-law normative legal acts regulate the work of the state institution studied in the article in more detail and meaningfully. It was established that in the system of legal principles regulating the activity of the National Guard of Ukraine, the key place belongs to the norms of the administrative field of law, because it is with their help: a) the administrative-legal status of this department is determined precisely as an entity that implements the law enforcement function of the state (in particular: purpose, tasks, functions, powers, competence, etc.); b) the administrative and legal forms of activity of the National Guard of Ukraine in the researched direction are revealed; c) outline guarantees of activity; d) the order of interaction of the National Guard of Ukraine with other law enforcement agencies is established; etc.

Установлен круг нормативно-правовых актов, направленных на регулирование деятельности Национальной гвардии Украины. Приведен ряд аргументов, подтверждающих, что в системе правовых основ деятельности Национальной гвардии Украины как субъекта правоохранительной деятельности ключевое место принадлежит нормам административной отрасли права.
