Рішення Європейського суду з прав людини як джерела кримінального процесуального законодавства України : дисертація

Abstract

У дисертаційному дослідженні на підставі аналізу положення чинного законодавства України та сучасної практики його застосування вирішено наукове завдання, що покладається у визначенні впливу застосування рішень та практики Європейського Суду з прав людини на систему норм, пов'язаних із розвитком питань щодо охорони права, свободи та законних інтересів учасників кримінального проваджень, сформульовано та обґрунтовано низько теоретичних проблем та практичних рекомендацій щодо утворення національного кримінального процесуального законодавства з європейськими стандартами права та свободою людини, що є частиною необхідних умов інтеграції України в європейський правовий простір.In the dissertation research, based on the analysis of the provisions of the current legislation of Ukraine and the modern practice of its application, the scientific task of determining the impact of the application of decisions and practice of the European Court of Human Rights on the system of norms related to the development of issues related to the protection of rights, freedoms and legitimate interests of participants in criminal proceedings has been solved, low-level theoretical problems and practical recommendations have been formulated and substantiated for the formation of national criminal procedural legislation with European standards of law and human freedom, which is part of the necessary conditions for the integration of Ukraine into the European legal space.
