Анотація
Проаналізовано чинне законодавство зарубіжних країн з метою вироблення єдиних концептуальних підходів до розуміння правової природи та особливостей системи обмежень суддів при здійсненні ними професійних обов'язків, а також виявлення
позитивниго зарубіжного досвіду у цій галузі. Наголошено, що у кожній національній правовій системі, в умовах сучасності, ідея щодо необхідності обмеження у правовому становищі суддів є загальновизнаною. При цьому, національні традиції нормотворення, правовий менталітет та правова культура інколи по різному визначають правообмеження судів при виконанні свої суддівських обов’язків. Саме ці фактори й позначилися на різному нормативно-правовому закріпленні видів і об’ємів правообмежень суддів у зарубіжних країнах.
In every national legal system, in the modern world, the idea of the need to limit the legal status of a judge is widely recognized. This is due to the fact that judges have specific powers to administer justice. Therefore, judges have high requirements for both a professional plan (having a law degree and a certain length of service) as well as moral (no criminal record, flawless, spotless reputation), as well as requirements for certain life experience (advanced age for holding the office of judges), etc. Within the scope of this scholarly article, the principle of the legal status of judges as judicial incompatibility, which is defined as a constitutionally or legally defined requirement that a judge cannot hold certain positions or engage in certain activities, is of particular interest. For a better understanding of the nature, content and limits of the requirements for restrictions on the legal status of judges, there is a need to study the rules of current law of foreign countries (for example, Poland and China), which provide for such restrictions on judges. The urgency of the theoretical and legal analysis of the rules of the legislation of foreign countries on fixing restrictions in the legal position of judges, first of all, due to the need to work out the optimal combination of guarantees of professional activity of judges and ensure their rights and freedoms, determine the compliance of the rules of national legislation of foreign countries with international legal standards in the field of law, as well as discussions on this issue in the media, academia and government. The purpose of this article is to analyze the current legislation of foreign countries with the purpose of developing common conceptual approaches to understanding the legal nature and characteristics of the system of restrictions of judges in the exercise of their professional duties, as well as to identify positive foreign experience in this field. It is concluded that in every national legal system, in modern conditions, the idea of the need to limit the legal status of judges is generally accepted. At the same time, national traditions of rule-making, legal mentality and legal culture sometimes define the legal restrictions of courts in the performance of their judicial duties in different ways. It is these factors that have affected the different legal and regulatory types of judges in foreign countries.
