Зарубіжний досвід правового регулювання праці суддів та можливості його використання в контексті вдосконалення принципів правового регулювання праці суддів в Україні

Abstract

Здійснено аналіз зарубіжного досвіду правового регулювання праці суддів. Опрацьовано можливості використання найбільш позитивного досвіду ряду європейських держав (на прикладі Великобританії, Франції та Німеччини) з метою вдосконалення принципів правового регулювання праці суддів в Україні. Наголошено, що на сьогоднішній день в Європі сформувались досить різноманітні підходи до правового регулювання праці суддів. В переважній більшості держав робиться акцент на незалежності та самостійності діяльності судів та суддів, що досягається шляхом особливої процедури відбору осіб на посаду суддів, а також високим рівнем їх соціального, фінансового та матеріально-технічного забезпечення.

The relevance of the article is that Ukraine has chosen a priority foreign policy strategy of European integration strategy, which necessitates the adaptation of national legislation to the legal system of sustainable democracies. The institute of legal regulation of judges’ work, as a socio-legal phenomenon, is of universal importance for all legal systems of the world. That is why the scientific value of comparative analysis of legislation, state-building practice and doctrinal doctrines in the aspect of research of legal regulation of judges’ work is justifiably not limited to time limits or borders of nation states. The article, based on the analysis of scientific views of domestic and foreign scientists, analyzes the foreign experience of legal regulation of judges. Possibilities of using the most positive experience of a number of European countries (on the example of Great Britain, France and Germany) in order to improve the principles of legal regulation of judges in Ukraine have been studied. It is concluded that today in Europe there are quite different approaches to the legal regulation of judges. In the vast majority of countries, the emphasis is on the independence and autonomy of courts and judges, which is achieved through a special procedure for the selection of judges, as well as a high level of their social, financial and logistical support. Therefore, from the above, we can formulate our own vision of the possibilities of using positive foreign experience in the legal regulation of the work of judges in order to improve and expand the principles of appropriate regulation. Thus, the relevant principles should be extended to such principles as: - the principle of ensuring a flexible approach to the formation of working hours of judges. This principle stipulates the need to take into account the personal interests of the judge (for example, the presence of his / her minor children) when setting his / her work schedule; − the principle of gradual training of judges of different levels. This implies that the training of judges at different stages should be carried out according to a certain program, and the completion of each stage is accompanied by passing various exams; − the principle of continuous (uninterrupted) training of judges throughout their careers, carried out by a specially authorized entity. This, in turn, will lead to highquality personal and professional growth of judges, and as a result, improve the state of justice in the country.

Осуществлен анализ зарубежного опыта правового регулирования труда судей. Проработаны возможности использования наиболее положительного опыта ряда европейских государств (на примере Великобритании, Франции и Германии) с целью усовершенствования принципов правового регулирования труда судей в Украине. Отмечено, что на сегодняшний день в Европе сформировались разнообразные подходы к правовому регулированию труда судей. В подавляющем большинстве государств делается упор на независимость и самостоятельность деятельности судов и судей, что достигается путем особой процедуры отбора лиц на должность судей, а также высоким уровнем их социального, финансового и материально-технического обеспечения.
