Еволюція становлення поняття «місцевого самоврядування» у системі політичних та правових учень (на прикладі ХІХ ‒ першої половини ХХ століття)

Abstract

Надано аналіз особливостей становлення та трансформації поняття «місцевого самоврядування» у системі політичних та правових учень. Акцентовано увагу на тому, що у різних країнах існують досить різноманітні концепції самоврядування, більш-менш враховують історичний досвід, традиції і правову культуру населення. Разом з тим в світі не існує жодної концепції самоврядування, яку можна було б визнати ідеальною і прийняти як еталон, адже кожна із них стала результатом тих чи інших соціально-економічних чи політичних перетворень, при цьому теоретичні і політичні пристрасті найчастіше пояснювалися реальною соціально-політичною обстановкою.The scientific article is devoted to the study and comprehensive analysis of the features of the formation and transformation of the concept of «local self-government» in the system of political and legal students. Taking into account the doctrinal study, it is stated that an analysis of the formation of the concept of «local self-government» in world and domestic scientific opinion indicates that the main conceptual and substantive characteristics of local self-government in the XIX‒XX century can be considered, in particular: the presence of common interests of residents of administrative units as the basis for the emergence and development of local selfgovernment; the principle of the election of local self-government bodies and their responsibility to the population; not the sovereignty of the local self-government authority within the State Union and the other order of its formation than that of the central authority; local self-government obtaining power from the state in the person of the central government, but their implementation only by local residents; the independent exercise by the local population of the tasks of public administration within the framework of the powers granted to local self-government bodies; the right of local governments to administer all local affairs except those entrusted to central governments. It emphasized that in different countries there are quite diverse concepts of self-government, more or less taking into account the historical experience, traditions and legal culture of the population. However, there is no concept of selfgovernment in the world that can be recognized as ideal and accepted as a standard, because each of them was the result of various socio-economic or political transformations, while theoretical and political passions were most often explained by the real socio-political situation. The role and significance of the problem of local selfgovernment in Europe can be evidenced, in particular, by the fact of no less than two centuries of discussion between the «public» and «state» schools of self-government, each of which in its own way interprets the problem of the origin of local selfgovernment and its relationship with state authorities and governments.Представлен анализ особенностей становления и трансформации понятия «местного самоуправления» в системе политических и правовых учений. Акцентировано внимание на том, что в разных странах существуют разнообразные концепции самоуправления, более или менее учитывают исторический опыт, традиции и правовую культуру населения. Вместе с тем в мире не существует никакой концепции самоуправления, которую можно было бы признать идеальной и принять как эталон, ведь каждая из них стала результатом тех или иных социально-экономических или политических преобразований, при этом теоретические и политические страсти чаще всего объяснялись реальной социально-политической. обстановкой.
