Анотація
Досліджено питання застосування принципу non bis in idem під час розслідування домашнього насильства. Наголошено, що домашнє насильство було та залишається одним із небезпечних протиправних діянь, що посягає на життя та здоров’я, честь і гідність людини. Окреслено чинні нормативно-правові документи, що закріплюють положення non bis in idem. Встановлено, що
якісний критерій систематичності вчинення домашнього насильства демонструє зв’язок між діяннями кривдника, їх внутрішньою єдністю, що утворюють певну лінію поведінки винного щодо конкретного потерпілого чи потерпілих.
The article is devoted to the study of the non bis in idem principle in the investigation of domestic violence. It has been emphasised that domestic violence has been and remains one of the most dangerous unlawful acts that infringes on human life and health, honour and dignity. It has been identified the current regulatory and legal documents that enshrine the non bis in idem provision. It has been established that the qualitative criterion of the domestic violence systematic nature demonstrates the connection between the abuser's actions and their internal unity, which form a certain line of the perpetrator's behaviour towards a particular victim or victims. The importance of establishing a quantitative criterion for the systematic nature of domestic violence has been indicated. Attention has been paid to the way in which bringing to administrative responsibility affects the observance of the non bis in idem principle by law enforcement agencies and national courts. It has been established that if a person has previously been brought to administrative liability for an offence under Article 173-2 of the Code of Administrative Offences, this does not preclude the possibility of bringing such a person to criminal liability under Article 126-1 of the Criminal Code of Ukraine. It has been noted that an investigation of domestic violence should be initiated in the presence of preliminary facts of bringing a person to both administrative and criminal liability. It has been analysed the practice of courts regarding the observance of the principle of non bis in idem in the course of domestic violence investigation. It has been concluded that a previous bringing of a person to administrative liability for domestic violence, provided that the unlawful acts are repeatedly committed against a certain victim or persons and specific consequences are determined by the legislator as more severe than those specified in the legislation of Ukraine on administrative offences, does not indicate double legal liability of the same type for the same offence.
Исследован вопрос применения принципа non bis in idem при расследовании домашнего насилия. Отмечено, что домашнее насилие было и остается одним из опасных противоправных деяний, посягающих на жизнь и здоровье, честь и достоинство человека. Обозначены действующие нормативно правовые документы, закрепляющие положения non bis in idem. Установлено, что качественный критерий систематичности совершения домашнего насилия демонстрирует связь между действиями обидчика, их внутренним единством, образующим определенную линию поведения виновного в отношении конкретного потерпевшего или пострадавших.
