Місце договірних відносин роздрібної купівлі-продажу у системі договірних зобов’язань

Abstract

Досліджено особливості договірних відносин роздрібної купівлі-продажу, розкрито зміст цього договору, його співвідношення з договором купівлі-продажу та з іншими суміжними договорами. За допомогою систематизації договірних відносин з’ясовано місце договірних відносин роздрібної купівлі-продажу у системи договірних зобов’язань.Features of the contractual relations of retail purchase and sale are studied in the article; the content of this agreement, its relationship with the contract of purchase and sale and other related agreements are revealed. To establish differences of contractual relations of purchase and sale from other relations, with the assistance of which the turnover of property is mediated, the author has carried out their comparison with contractual rent relations. The article’s objective is to analyze the existing theoretical views about the place of contractual relations of retail purchase and sale in the system of contractual obligations. With the assistance of systematization of contractual relations the author has revealed the place of contractual relations of retail purchase and sale in the system of contractual obligations. The author has analyzed existing judicial practice in cases of new types of agreement of retail purchase and sale of goods – the contract of retail purchase and sale of goods concluded in the Internet and the contract of retail purchase and sale of goods using the gift certificate. It is concluded that contractual specifics of the contract of retail purchase and sale makes it closer to the basic model contract – the contract of purchase and sale and, simultaneously, distinguishes it from other similar contracts. Thus, the contracts of purchase and sale of goods (property) concluded via the Internet and using the gift certificate are new contractual forms (types) of the contract of retail purchase and sale of goods. Accordingly, their place in the system of contractual obligations is determined by the typical affiliation to a number of agreements that are intended to transfer ownership of the property, the main of which is the contract of purchase and sale. This is due to the fact that they match according to their common traits and the purpose of their obligation. Therefore, the contract of retail purchase and sale rightly belong a place in the same group with the contract of purchase and sale, differing from the latter by the specifics of its contractual obligation. Consequently, these agreements should be placed in the same section with the contract of retail purchase and sale, because of their specific characteristics they are closer to this type of contract of purchase and sale.Исследованы особенности договорных отношений розничной купли-продажи, раскрыто содержание этого договора, его соотношение с договором купли-продажи и с другими смежными договорами. С помощью систематизации договорных отношений выяснено место договорных отношений розничной купли-продажи в системы договорных обязательств.
