Поняття земель загального користування

Abstract

Запропоновано науковий підхід до визначення поняття земель загального користування. За допомогою методу аналізу визначено найбільш важливі ознаки цих земель та запропоновано визначення поняття «землі загального користування». Обґрунтовано необхідність законодавчого закріплення наданого визначення.

Insufficient determination of legal statuses of various land areas is the shortcoming of modern Ukrainian land legislation. The legal status of lands of public service is the most uncertain among others. There is no even conception of «Lands of Public Service» in the legislation. Comprehensive analysis of determination of this conception wasn’t also made in land and legal science. Thus, before determining the features of the legal status of lands of public service, the conception of lands of public service is needed to be defined, that means the estimation of land areas to which this status can be applied. The aim of the research is to highlight the most important features and the conception of «Land of Public Service» with the help of analysis method. The typical features of lands of public service are marked out by the author within the research. The author proves that these lands are in state or municipal ownership; appropriated for exercising of the public service right; appropriated to satisfy public needs, namely physical persons; in composition of different category of lands. The objects of public service such as natural objects or elements of infrastructure, which are necessary to satisfy public needs, are located on these land areas. The mentioned features provide grounds to define the conception of lands of public service. These lands are the land areas, which are appropriated for exercising the right on public use by unlimited circle of physical persons, who follow norms, rules and standards. These circumstances create legal status of relevant categories of lands, state or municipal ownership land areas, where the objects of public service are located. A lot of problems appear in practice while settling land relations, because of the absence of the conception of «Lands of Public Service» in current legislation. Thus, the author believes that the conception of «Lands of Public Service» is needed to be enshrined in the law.

Предложен научный подход к определению понятия земель общего пользования. С помощью метода анализа определены наиболее важные признаки этих земель и предложено определение понятия «земли общего пользования». Обоснована необходимость законодательного закрепления предложенного понятия.
