Класифікація гарантій соціального захисту військовослужбовців

Abstract

Здійснено класифікацію гарантій соціального захисту військовослужбовців. Розкрито сутність поняття «соціальний захист», з’ясовано зміст категорії «гарантії». Проаналізовано норми чинного законодавства, яке регулює питання соціального захисту військовослужбовців.

The article focuses on the fact that in the scientifi c literature there are many approaches to the classifi cation of guarantees of social protection of military personnel. It is argued that the most expedient are the types of grouping of the mentioned guarantees based on the following criteria: 1) the source of securing the guarantees: a) constitutional (or general); c) legislative (or special); d) fi xed in by-laws (specialized); 2) nature of security provided by the state: a) guarantees of monetary security; b) guarantees of service time and rest from service; c) guarantees of housing provision; d) guarantees of freedom of cultural and spiritual life; e) guarantees of medical care; e) food and material security guarantees; 3) depending on the nature, state guarantees of social protection of military personnel can be divided into the following groups: a) material-legal and proceduralprocedural; b) regulatory and security. In general, the above grouping criteria and types of guarantees of the specifi ed protection of servicemen are the most appropriate, since they clearly and clearly refl ect the essential content and meaning of these guarantees as a tool (means) of strengthening and comprehensively ensuring the status of a serviceman.

Осуществлена ​​классификация гарантий социальной защиты военнослужащих. Раскрыта сущность понятия «социальная защита», выяснено содержание категории «гарантии». Проанализированы нормы действующего законодательства, регулирующего вопросы социальной защиты военнослужащих.
