Принципи правового регулювання трудових прав працівників органів прокуратури

Abstract

Надано правовий аналіз категорії принципів правового регулювання трудових прав працівників органів прокуратури України та їх класифікації. Розглянуто сутність поняття «принципи права», «принципи правового регулювання» та їх основні властивості. Розкрито зміст суспільних відносин, що виникають при вступі особи на службу в органи прокуратури України, що відрізняється від інших трудових відносин перетином сфер дії трудового й адміністративного права. Наголошено, що принципи правового регулювання трудових прав працівників органів прокуратури України – це керівні засади направлені на врегулювання суспільних відносин, які виникають у зв’язку із набуттям особою трудових прав під час вступу на службу в органи прокуратури.The article is dedicated to a legal analysis of the principles of legal regulation of Ukraine’s prosecutor’s office employees’ labour rights and their classification. Modern legislation does not establish such a concept, and its theoretical analysis has been conducted for the first time. However, determining the principles of legal regulation of Ukraine’s prosecutor’s office employees’ labour rights has significant practical and theoretical value, since it determines the guidelines for the establishment and regulation of legal rights of this employees’ category. The article examines the essence of the concept of “legal principles”, as well as the natural and positivist approaches to its legal interpretation. Besides, the article determines the main (subject and genetic) characteristics of legal principles. A description of the “principles of legal regulation” concept and its key properties is provided. The concepts of “legal principles” and “principles of legal regulation” are delimited on the basis of scientific views. Separately, the principles of employment law and principles of legal regulation of legal labour relations themselves are researched, and their classification is given. It is determined that the principles of legal regulation of labour rights are a component of the principles of legal regulation of legal labour relations. The principles of legal regulation of labour rights are categorized for the first time on the basis of the theoretical analysis of the works of national scientists. The article details the contents of social relations that appear upon entering the service in Ukraine’s prosecutor’s office; these contents differ from other labour relations in the intersection of the domains of labour and administrative laws. The listing of the principles of legal regulation of service and labour relations of prosecutor’s office employees is determined. The research of the implementation of the principles we have identified into the legal regulation of employees’ labour rights in individual articles of The Law of Ukraine “On the Public Prosecutor’s Office” was conducted. By summarizing the research the conclusion was reached that the principles of regulation of Ukraine’s prosecutor’s office employees’ labour rights are the guidelines aimed at the control of social relations that appear in connection with an individual’s acquirement of labour rights upon entering the service in the prosecutor’s office.Представлен правовой анализ категории принципов правового регулирования трудовых прав работников органов и их классификации. Рассмотрена сущность понятия «принципы права», «принципы правового регулирования» и их основные свойства. Раскрыто содержание общественных отношений, возникающих при вступлении лица на службу в органы прокуратуры Украины, отличающееся от других трудовых отношений пересечением сфер действия трудового и административного права. Отмечено, что принципы правового регулирования трудовых прав работников органов прокуратуры Украины – это руководящие принципы, направленные на урегулирование общественных отношений, возникающих в связи с приобретением лицом трудовых прав при поступлении на службу в органы прокуратуры.
