До характеристики мети, завдань та функцій дисциплінарного провадження

Abstract

Розглянуто сутність та зміст категорій «мета» і «завдання». Встановлено як співвідносяться дані категорії. Запропоновано авторське бачення щодо мети дисциплінарних проваджень. Відповідно до мети сформульовано завдання, які необхідно вирішити для її досягнення. Встановлено сутність та зміст поняття «функція дисціплінарного провадження». Наведено перелік основних функцій дисциплінарних проваджень. Наголошено, що функції дисциплінарного провадження варто розтлумачити як сукупність робочих векторів реалізації інституту дисциплінарного провадження, належне та безперервне здійснення яких визначає ефективність останнього, а також повноту виконання поставлених перед ним мети та завдань.

The relevance of the article is that ensuring compliance with and protection of labor rights of employees is an important task of the Ukrainian legislator. One of the institutes aimed at solving these problems is disciplinary proceedings. The latter, in turn, is a complex institution in its structure and content, and therefore, an important theoretical and practical issue is to determine the purpose, objectives and functions of its implementation. It is worth noting that most scientists interpret the concepts of «goal» and «task» in the same way, drawing not just a parallel between them, but perceiving them as synonyms. However, this approach is erroneous, as each of these terms characterizes a separate part of the category to which it belongs. The article, based on the analysis of scientific views of scientists, established the essence and content of the categories «goal» and «task». The author’s vision of the purpose of disciplinary proceedings is offered. In accordance with the goal, the tasks that need to be solved to achieve it are formulated. The essence and content of the concept «function of disciplinary proceedings» is established. The list of the main functions of disciplinary proceedings is given. It is concluded that the functions of disciplinary proceedings should be interpreted as a set of working vectors of the institute of disciplinary proceedings, proper and continuous implementation of which determines the effectiveness of the latter, as well as the completeness of its goals and objectives. Elaboration of legislative, by-law and doctrinal sources shows the lack of a unified and systematic approach to the list of functions of the institute of disciplinary proceedings in labor law of Ukraine, as well as an explanation of their content. However, given the essence of this category, its special importance as a guarantee of labor rights of employees, as well as some regulatory regulators of the latter, it is appropriate to propose the following list of functions of disciplinary proceedings: 1) termination function; 2) preventive function; 3) educational function; 4) informative function; 5) evolutionary function.

Рассмотрены сущность и содержание категорий "цель" и "задачи". Установлены как соотносятся данные категории. Предложено авторское видение цели дисциплинарных производств. Согласно цели сформулированы задачи, которые необходимо решить для ее достижения. Установлены сущность и содержание понятия «функция дисциплинарного производства». Приведен список основных функций дисциплинарных производств. Отмечено, что функции дисциплинарного производства следует истолковать как совокупность рабочих векторов реализации института дисциплинарного производства, надлежащее и непрерывное осуществление которых определяет эффективность последнего, а также полноту выполнения поставленных перед ним целей и задач.
