Анотація
На прикладі світових тенденцій застосування спеціальних технічних засобів визначено актуальність прокурорського нагляду за здійсненням оперативно-розшукової діяльності з використанням інформаційно-телекомунікаційних систем. Проаналізовано повноваження прокурора у цій сфері. Розкрито предмет та завдання прокурора під час здійснення відповідної наглядової діяльності. Окреслено типові порушення, які можуть бути виявлені прокурором. Запропоновано виокремити спеціалізацію прокурорів щодо нагляду за здійсненням оперативнорозшукової діяльності з використанням інформаційно-телекомунікаційних систем.
Usage of computer technologies by law-enforcement agencies in combating against criminality is an urgent issue in the modern terms of technical development. At the same time using of such technologies must be in severe accordance to law. A leading agency, which must provide such legality in modern terms is prosecutorʼs office. Prosecutorʼs authorities in realizing supervision over the use of the informational and telecommunication systems by law-enforcement agencies within operative and search activities are stated in the laws of Ukraine «About the Prosecutorʼs Office», «About Operative and Search Activity», Criminal Procedural Code, etc. Under the norms of current legislation and scientific thought in this sphere, the subject of prosecutorʼs supervision over realizing operative and search activity with the use of the informational and telecommunication systems by internal affairs agencies is formulated. This object is directions of keeping legislation by internal affairs agencies in the field of realizing operative and search activity, if informational and telecommunication systems are used for its realization or automation. The corresponding tasks in the context of researched issues are also outlined in the paper. They are prevention of hi-tech criminal offences; protection of physical and legal entities from criminal encroachments, which are carried out with the use of the informational and telecommunication systems, or when their tracks may be stored in these systems; guaranteeing of the set order of realizing and automation process of operative and search activity with the use of informational and telecommunication systems; protection of citizens rights and freedoms while using special hardware and software measures of informationʼs secret obtaining. Considering practical experience the main ways of cooperation with operative divisions, establishment of mutual responsibility are offered. It is stressed that there is a need to introduce the corresponding specialization of a prosecutor with simultaneous implementation of some themes in a course of prosecutorʼs supervision into the training process of law higher educational establishments. These themes should be devoted to the supervision over operative and search activity realized by internal affairs agencies with the use of informational and telecommunication systems. It is useful to develop methodical recommendations concerning realization of prosecutorʼs authorities over the researched direction in the paper.
На примере мировых тенденций применения специальных технических средств определена актуальность прокурорского надзора за осуществлением оперативно-розыскной деятельности с использованием информационно-телекоммуникационных систем. Проанализированы полномочия прокурора в этой сфере. Раскрыты предмет и задачи прокуратуры во время осуществления соответствующей надзорной деятельности. Очерчены типичные нарушения, которые могут быть обнаружены прокурором. Предложено выделить специализацию прокуроров по надзору за осуществлением оперативно-розыскной деятельности с использованием информационно-телекоммуникационных систем.
