До характеристики стану правового регулювання кар'єрного росту поліцейських

Abstract

Надано оцінку сучасному стану правового регулювання кар’єрного росту в Національній поліції України. Наголошено, що правове регулювання кар'єрного росту поліцейських слід тлумачити як вплив права на суспільно-правові відносини, що виникають в сфері трудової діяльності працівників поліції та їх просування по службі, виражений у спеціальному механізмі регулювання, тобто системі правових інститутів, положень, фактів та норм, закріплених у нормативно-правових актах законодавчого та підзаконного рівнів.

The relevance of the article lies in the fact that the specifics of the career growth of police officers and the factors that influence it are significantly different from similar aspects of the labor activity of many other categories of employees. This is primarily related to the specifics of the official and labor status of police officers, as well as the tasks they perform every day. At the same time, the effectiveness of the police officers in their work, and as a result, their career growth, directly depends on the quality of the regulatory and legal regulation of the specified institute, to the study of the state of which the presented scientific study will be devoted. The article focuses on the variety of scientific approaches to the definition of the term "legal regulation". The conducted analysis made it possible to formulate the author's definition of the concept of "legal regulation of the career growth of police officers". Based on the analysis of normative legal acts of different legal force, an assessment of the current state of legal regulation of career growth in the National Police of Ukraine is provided. It is emphasized that the legal regulation of the career growth of police officers should be interpreted as the influence of the law on social and legal relations arising in the sphere of labor activity of police officers and their promotion in the service, expressed in a special regulatory mechanism, that is, a system of legal institutions, provisions, facts and norms fixed in normative legal acts of the legislative and sub-legal levels. The formalized nature of legal regulation suggests that the quality and efficiency of the category is indicated by the normative and legal provisions that establish its mechanism. Therefore, in order to assess the state of legal regulation of the career post of police officers, it is necessary to analyze the legislative and by-law documents that are relevant to this issue. It was concluded that the norms of labor law form the basis of legal regulation of labor relations, in other words, they are fundamental, model standards, a system of requirements that must be ensured in the conditions of organizing a specific type of work at any enterprise, institution or organization. In turn, administrative norms are a supplement. They ensure the official, state nature of the work of police officers, the implementation into the system of their labor status of the functions of the state, additional labor guarantees, as well as special conditions, factors and other features of career growth related, first of all, to the concentration of these employees in their hands of state power powers.

Дана оценка современному состоянию правового регулирования карьерного роста в Национальной полиции Украины. Отмечено, что правовое регулирование карьерного роста полицейских следует толковать как влияние права на общественно-правовые отношения, возникающие в сфере трудовой деятельности работников полиции и их продвижение по службе, выраженное в специальном механизме регулирования, то есть системе правовых институтов, положений, фактов и норм, закрепленных в нормативно правовых актах законодательного и подзаконного уровней.
