Шляхи вдосконалення правових та організаційних засад застосування дисциплінарних стягнень до працівників поліції

Abstract

Проаналізовано доктринальні джерела на предмет існуючих теоретичних позицій про вдосконалення інституту дисциплінарної відповідальності в сучасній трудовій галузі права та вироблено шляхи вдосконалення правових та організаційних засад застосування дисциплінарних стягнень саме в контексті роботи працівників поліції.

To date, the disciplinary responsibility of police officers is characterized by a broad legal framework, which includes acts of both international and national legislation, which regulate not only the procedure, but also the guarantees and principles of application to police disciplinary sanctions. At first glance, the existing model has no negative sides and does not need any modifications. However, nothing in the modern world is perfect, so it is logical to pay attention to possible and priority ways of improving the legal and organizational principles of applying disciplinary sanctions to police officers. The purpose and task of the article is to analyze doctrinal sources for the subject of existing theoretical positions on improving the institution of disciplinary responsibility in the modern labor field of law and to develop, on the basis of this, ways of improving the legal and organizational principles of applying disciplinary sanctions in the context of the work of police officers. It was concluded that the legal framework regulating the procedure for applying disciplinary sanctions to police officers needs significant improvement. At the same time, this issue tends to rethink not only special legal acts, but also general ones. Disciplinary commissions should become the only authority that makes a decision on the application of one or another disciplinary penalty. Yes, this moment should not be left to the discretion of the manager, because the latter is in any case an interested person who, in the process of imposing a penalty, may not be guided by the motive to educate the policeman, but to punish him taking into account some subjective factors. In this regard, decisions of disciplinary commissions must be binding and contain not recommendations on the type of disciplinary penalty, but a specific decision. The composition of a police officer’s disciplinary offense requires legislative clarification, as well as establishing the gradation of disciplinary penalties in accordance with the committed offense. In other words, it is necessary to determine for which specific actions and the negative consequences of the latter, a particular disciplinary penalty may be applied to a police officer.

Проанализированы доктринальные источники на предмет существующих теоретических позиций об усовершенствовании института дисциплинарной ответственности в современной трудовой отрасли права и выработаны пути усовершенствования правовых и организационных основ применения дисциплинарных взысканий именно в контексте работы сотрудников полиции.
