Рівні механізму забезпечення кримінологічного захисту ЗМІ

Abstract

Висвітлено питання конкретизації рівнів механізму забезпечення кримінологічного захисту засобів масової інформації в Україні та визначення його особливостей. Наголошено, що в сучасних умовах визначення рівнів механізму забезпечення кримінологічного захисту ЗМІ залежить як від визначення об’єктів такого від впливу злочинності, так і від різновидів суб’єктів, які будуть забезпечувати такий кримінологічний захист. Зазначено, що врахування специфіки об’єктів забезпечення механізму кримінологічного захисту ЗМІ та рівнів такого забезпечення є необхідним для конкретизації форм та методів такого забезпечення, системи суб’єктів забезпечення цього механізму, а також визначення слабких та сильних сторін функціонування такого механізму задля його удосконалення та підвищення ефективності.

The article highlights the issues of specifying the levels of the mechanism for ensuring the criminological protection of the media in Ukraine (media) and determines its features. It is noted that in modern conditions, the identifying levels of the mechanism for ensuring criminological protection of the media depends both on the definition of media objects that are affected by crime, and the types of subjects that will provide such criminological protection. Taking into account the approaches existing in criminological science to determining the levels of criminological security and counteraction crime, the author considers the classification of the levels of the mechanism for ensuring the criminological protection of the media, depending on the following criteria: on the scale of its implementation (within the country); from the territory of distribution; from the actors who provide this mechanism; from the transnational component of the subjects who exercise the defense, as well as depending on the presence or absence of a potential impact on the media of armed aggression (armed conflict). Depending on the scale, such a mechanism can be organized at the state, regional and local levels. On the territory of distribution, this mechanism can be implemented at: national (operates within a single country) and international (ensuring occurs at the expense of international institutions and extends to most countries of the world) levels. The author concretizes the subjects of ensuring the mechanism of criminological protection of the media both at the national (seven groups of subjects are identified depending on their competence) and at the international (two groups of subjects are identified) levels. Depending on the transnational component, the ensuring of a mechanism for the criminological protection of the media can function at: the global level (provided by the UN, other international institutions, including those with law enforcement functions), the regional level (for example, organizations of the European Union), the national level (includes public and private subjects who are authorized or involved in ensuring criminological protection (media). Depending on the subjects that provide this mechanism, the mechanism can be ensured: 1) at the level of internal self-organization of the media (internal security); 2) at the level of activities of external subjects authorized to perform law enforcement or auxiliary functions in the field of media activities. Depending on the presence or absence of the potential impact of armed aggression (armed conflict), the author highlights: 1) a mechanism for ensuring the criminological protection of the media operating in the territory where there is no potential influence of the armed aggression of the Russian Federation; 2) a mechanism for ensuring the criminological protection of the media operating in the territory where there is a potential influence of the armed aggression of the Russian Federation. It is concluded that the concretization of the levels of the mechanism for ensuring the criminological protection of the media is necessary for further concretization of the forms and methods of such support, the system of subjects of ensuring this mechanism, as well as identifying the weak and strong sides of the functioning of such a mechanism.

Освещены вопросы конкретизации уровней механизма обеспечения криминологической защиты средств массовой информации в Украине и определение его особенностей. Отмечено, что в современных условиях определение уровней механизма обеспечения криминологической защиты СМИ зависит как от определения объектов такого воздействия преступности, так и от разновидностей субъектов, которые будут обеспечивать такую ​​криминологическую защиту. Отмечено, что учет специфики объектов обеспечения механизма криминологической защиты СМИ и уровней такого обеспечения необходимы для конкретизации форм и методов такого обеспечения, системы субъектов обеспечения этого механизма, а также определения слабых и сильных сторон функционирования такого механизма для его усовершенствования и повышения эффективности.
