До характеристики принципів організаційно-правового забезпечення медичного обслуговування членів сімей поліцейських

Abstract

Визначено поняття принципів організаційно-правового забезпечення медичного обслуговування членів сімей поліцейських. Здійснено класифікацію вказаних принципів, в рамках якої виділено: а) загальноправові принципи, б) галузеві принципи; в) спеціальні принципи. Відмічено, що окреслені принципи не знайшли свого законодавчого закріплення, а відтак ця прогалина вимагає внесення змін та доповнень до діючого загального та спеціального законодавства. Принципи організаційно-правового забезпечення медичного обслуговування членів сімей поліцейських являють собою розчинену у положеннях норм чинного законодавства систему вихідних начал, основоположних ідей, базових засад діяльності суб’єктів надання медичних послуг членам сімей поліцейських в закладах охорони здоров’я Міністерства внутрішніх справ України.The relevance of the article lies in the fact that the assessment of the fundamental aspects of medical care for family members of police officers, such as the regularity of the development of this activity, its legal essence, the status of the subjects of implementation and the legal basis, also implies the need to pay attention to the practice of providing medical services. This forms a separate problem, which is filled with interesting and sometimes controversial issues – the problem of analyzing the principles of organizational and legal support of the relevant activity. In the article, based on the analysis of scientific views of scientists, the author's definition of the concept of the principles of organizational and legal provision of medical care for family members of police officers is proposed. The classification of the specified principles was carried out, within which the following were highlighted: a) general legal principles, b) branch principles; c) special principles. It is noted that the principles outlined in the article have not found their legislative consolidation, and therefore this gap requires changes and additions to the current general and special legislation. The principles of organizational and legal provision of medical care for family members of police officers represent a system of basic principles, fundamental ideas, basic principles of activity of entities providing medical services to family members of police officers in health care institutions of the Ministry of Internal Affairs of Ukraine dissolved in the provisions of current legislation. These principles are diverse in their nature and content, and therefore, it is most expedient to divide them into three groups: a) common law; b) sectoral; and c) special. It was concluded that each of the groups of principles we have given directly or indirectly determines the key ideas and directions for the implementation of this activity, however, it is the special initial principles that consolidate the basis of providing medical services in health care institutions of the Ministry of Internal Affairs to the specified subjects and direct legal regulation relevant activity. In conclusion, it should also be noted that the relevant principles have not found their legislative consolidation, and therefore this gap requires amendments and additions to the current general and special legislation in the sphere of regulation of official activities of police officers.Определены понятия принципов организационно-правового обеспечения медицинского обслуживания членов семей полицейских. Осуществлена ​​классификация указанных принципов, в рамках которой выделены: а) общеправовые принципы; б) отраслевые принципы; в) специальные принципы. Отмечено, что указанные принципы не нашли своего законодательного закрепления, поэтому этот пробел требует внесения изменений и дополнений в действующее общее и специальное законодательство. Принципы организационно правового обеспечения медицинского обслуживания членов семей полицейских представляют собой растворенную в положениях норм действующего законодательства систему исходных начал, основополагающих идей, базовых основ деятельности субъектов предоставления медицинских услуг членам семей полицейских в учреждениях здравоохранения Министерства внутренних дел Украины.
