Правові засади діяльності Національної гвардії України та місце серед них адміністративно-правового регулювання

Abstract

Сформовано комплексне бачення правових засад діяльності Національної гвардії України та визначено місце серед них адміністративно-правового регулювання. З’ясовано сутність понять «засади», «правові засади», «адміністративно-правове регулювання». Розкрито рівні системи правових засад діяльності НГУ, зокрема рівнів конституційно-правових норм, міжнародно-правових актів, законодавчих актів, підзаконних нормативно-правових актів, актів застосування норм права.

The article states that at the level of doctrinal understanding, along with legal principles, researchers also distinguish ecological and economic principles in the context of postmodern consciousness, methodological principles, organizational and legal principles, theoretical principles, worldview-conceptual and scientific-theoretical principles, financial-legal, moral principles, institutional principles, bioethical principles, etc. It is noted that in modern legal doctrine, in particular from the point of view of the philosophy of law, the problem of the ratio of general and specific at the level of legal regulation needs to be understood. The leading role at the level of this ratio is played by planning as a process of implementation of provisions defined at the normative and legal level in the daily actions of a specific public servant. It is emphasized that the essence of the administrative and legal regulation of the activities of the National Guard of Ukraine is revealed at the level of the system of normative and legal acts, the first, leading place among which, of course, belongs to the constitutional norms. The level of international legal acts includes the Convention for the Protection of Human Rights and Fundamental Freedoms, the International Covenant on Civil and Political Rights, the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment and Punishment. It is noted that at the level of legislative acts, which we consider as the basic level of administrative and legal regulation of the activities of the National Guard of Ukraine, the Law of Ukraine «On the National Guard of Ukraine», the Law of Ukraine «On the Armed Forces of Ukraine», the Law of Ukraine «On the Principles of Internal and Foreign Policy» should be singled out « and other. In the conditions of the Russian-Ukrainian war, the provisions of the Law of Ukraine «On the Legal Regime of Martial Law» become particularly important. The level of sub-statutory regulatory regulation of National Guard of Ukraine activity is made up by the orders of the Ministry of Internal Affairs of Ukraine. Attention is focused on the fact that the level of individual work plans, patrol routes, schemes according to operation plans is a separate grassroots (initial) level of legal regulation.

Раскрыты уровни системы правовых основ деятельности НГУ, в частности уровней конституционно-правовых норм, международно-правовых актов, законодательных актов, подзаконных нормативно-правовых актов, актов внедрения норм права.
