Припинення зобов’язання подружжя по утриманню за договором

Abstract

Розглянуто особливості припинення зобов’язання подружжя по утриманню за договором. Визначено, що Сімейний кодекс України регулює особливості укладення двох договорів між подружжям про припинення права на аліменти: договору про припинення права на утримання взамін набуття права власності на житловий будинок, квартиру чи інше нерухоме майно; договору між подружжям про припинення права на утримання у зв’язку з одержанням одноразової грошової виплати. Запропоновано внести зміни до Сімейного кодексу України та передбачити окремі підстави розірвання договору між подружжям про припинення права на утримання на вимогу відчужувача нерухомого майна за рішенням суду, якщо непрацездатність того з подружжя, хто потребував матеріальної допомоги, виникла в результаті вчинення ним умисного злочину чи була прихована від другого з подружжя при реєстрації шлюбу, чи одержувач аліментів свідомо поставив себе у становище такого, що потребував матеріальної допомоги.

The author of the article has studied the peculiarities of termination of the obligation of spouses for the maintenance under the contract. It has been determined that the Family Code of Ukraine regulates the peculiarities of concluding two agreements between the spouses on the termination of the right to alimony: the agreement on the termination of the right to maintenance in exchange for acquiring the right of ownership to a residential house, an apartment or other immovable property; the agreement between the spouses about the termination of the right to maintenance in regard to the receipt of a single-action payment in cash. It has been established that the agreement between the spouses about the termination of the right to maintenance in exchange for acquiring the right of ownership to a residential building, an apartment or other immovable property should be certified by a notary; the agreement between the spouses about the termination of the right to maintenance in regard to the receipt of a single-action payment in cash can be concluded in a simple written form. The provisions that there is a certain “legal similarity” of the legal construction of “compensation for release from obligation” and the legal structure of the agreement on the termination of the right to maintenance have found further development. It has been argued that all the requirements under the Civil Code of Ukraine, the observance of which is necessary for the validity of the transaction, are applied to the agreement between the spouses about the termination of the right to maintenance; the provisions of the Civil Code of Ukraine regulating the grounds and legal consequences of the invalidity of the transaction, the grounds and legal consequences of the change or termination of the agreement are also applied. The author has offered to amend the Family Code of Ukraine and to provide certain grounds for termination of the agreement between the spouses about the termination of the right to maintenance at the request of the alienator of immovable property by a court decision, if incapability of the spouse who needed the material assistance arose as the result of his commission of intentional crime or was hidden from another spouse while registering a marriage, or the recipient of alimony deliberately put himself in a situation, when he needed the material assistance.

Определены особенности прекращения права на содержание по договору супругов по семейному законодательству Украины и разработаны предложения по усовершенствованию действующего семейного законодательства в этой сфере.
