dc.description.abstractДосліджено особливості прояву принципу справедливості в механізмі правового регулювання відносин за участі комерційних банків і клієнтів — споживачів фінансових послуг. Зазначено, що однією з причин падіння довіри населення України до фінансових установ є недостатньо повно опрацьований правовий режим охорони та захисту прав слабкої сторони договірних правовідносин, до категорії яких належать клієнти банків. Це вказує на те, що справедливість наразі ще не набула повноти свого прояву в правовому регулюванні банківської діяльності. Установлено незадовільний стан економічної та правової науки щодо рівня теоретичного обґрунтування справедливості як одного із принципів банківської діяльності.uk_UA
dc.description.abstractThe authors have studied specific features of the manifestation of the principle of equity within the mechanism of legal regulation of relations with the participation of commercial banks and clients who are customers of financial services. It has been noted that one of the reasons for the decline of the confidence of the population of Ukraine to financial institutions is the insufficiently elaborated legal regime of security and protection of the rights of the weak party of the contractual legal relations, where the clients of banks belong to this category. This indicates that justice has not been fully implemented in the legal regulation of banking operations yet. The authors have established unsatisfactory state of economic and legal science regarding the level of theoretical grounding of justice as one of the principles of banking operations. Constitutional features of the principle of equity have been presented, including: equality of legal capacity of the subjects of legal relations, equality of action of legal claims, equality of the scale of legal assessment of the acts of the subjects of legal relations. The analysis of the banking legislation of Ukraine indicates a positive dynamics in introducing the system of legal norms assigned to level off the imbalance between the capabilities of commercial banks and their clients, which is a testament to the manifestation of political will of the legislator to gradual implementation of the principle of equity into the national banking legislation of Ukraine. The authors have indicated on the need for consistent and long-term educational work in order to increase the level of economic and legal literacy of the population in Ukraine. One of the elements of such work should be the promotion of the rules of legal dialogue between clients who are consumers of financial services and commercial banks or other financial institutions. The authors have emphasized the need of involving economic and legal science into such work. It has been concluded about the necessity to conduct specific scientific research regarding further elaboration of the mechanism of legal regulation of banking operations through the prism of the principle of equity.uk_UA
