Поняття та особливості правового статусу сезонних та тимчасових працівників як суб’єктів трудового права

Abstract

Надано визначення поняттю сезонних та тимчасових працівників. Відмічено, що дана категорія працівників володіє своїм, особливим трудо-правовим статусом. Наголошено, що сезонні та тимчасові працівники – це особлива категорія працівників, що вступає у трудові правовідносини з роботодавцем на певний (короткий) проміжок часу. Головне завдання цієї категорії працівників полягає у тому, щоб задовільнити потреби роботодавця у робочій силі на необхідний йому термін.

The article, based on the analysis of scientific views of scientists and the norms of current legislation, provides a definition of the concept of seasonal and temporary workers. It is noted that this category of workers has its own special legal status. Theoretical approaches to the interpretation of the concept of legal status and labor status of the employee are generalized, on the basis of which the author’s understanding of the term of the legal status of seasonal and temporary workers as subjects of labor law was offered. It was found that the key features of the legal status of seasonal and temporary workers as subjects of labor law are the following: a special area of employment; as the next feature of the legal status of seasonal and temporary workers as subjects of labor law it is necessary to note the special order of employment, the conclusion of the employment contract, implementation of labor activity, and the termination of labor legal relations; a specific list of legal guarantees in the implementation of labor relations; special procedure for registration of social assistance, vacations, etc.; the duration of employment relationships with seasonal and temporary workers is clearly limited. It is emphasized that seasonal and temporary employees are a special category of employees who enter into an employment relationship with an employer for a certain (short) period of time. The main task of this category of workers is to meet the needs of the employer in the workforce for the required period. The above, in fact, determines the specifics of the legal status of seasonal and temporary workers. It is determined that the legal status of seasonal and temporary workers as subjects of labor law is most appropriate to understand the legal position of the employee defined by the current general and special labor legislation, which is established through a set of relevant elements. The latter, in turn, are most appropriate to include: labor legal personality; subjective rights and legal obligations; legal, social, economic and other guarantees of their employment.

Дано определение понятию сезонных и временных работников. Отмечено, что данная категория работников обладает своим особым трудо-правовым статусом. Отмечено, что сезонные и временные работники – это особая категория работников, которая вступает в трудовые правоотношения с работодателем на определенный (короткий) период времени. Главная задача этой категории работников состоит в том, чтобы удовлетворить потребности работодателя в рабочей силе на необходимый ему срок.
