Особливості проведення слідчих (розшукових) дій під час розслідування злочинів у сфері економічної діяльності

Abstract

Розглянуто особливості проведення слідчих (розшукових) дій за новим КПК України при розслідуванні злочинів у сфері економічної діяльності. Показано специфіку проведення слідчого огляду місця події, допиту (свідка, підозрюваного, обвинуваченого, підсудного, експерта), обшуку, слідчого експерименту, підготовки та проведення експертиз (судово-технологічної, судово-товарознавчої, судово-хімічної, судово-бухгалтерської).

According to the new Code of Criminal Procedure of Ukraine features of investigative (search) actions while investigation of business crimes are observed. With the help of these actions circumstances of business crimes commission are cleared, among which are: the place of attachment of wealth, the presence of shortage or abundance on the factory; persons who took part in crime commission, their position and functional duties; modus operandi, the actions aimed at crime reticence; the subject of criminal trespass, rate of damages; who is involved in crime; connections of criminals with corrupt employees of controlling and law enforcement agencies, whether the facts of criminal activity are connected with jobbery, tax evasion etc. Specific character of investigative (search) actions is stated. Crime scene examination is one of the most common and primary investigative (search) actions, which are executed to reveal traces of the crime, real evidences, crime commission mechanism and other circumstances. Such facts are assigned while investigative examination of documents and stolen production. Interrogation has its features concerning obtaining of information. These features are stipulated by procedural status of the person, who is interrogated, position, interest in results of crime investigation, individual features and other circumstances. Crime scene examination is an important procedural tool while business crime investigation to receive evidences and to reveal stolen production, documents and scratch notes, treasures, which are saved up during criminal activity. Investigatory experiment – investigative (search) action that is executed by investigator or prosecutor to examine and specify facts, which are important for crime circumstances determination. Such actions are: reconstruction of actions, situation, circumstances of certain event, execution of required researches and tests. Forensic enquiry conduction has certain specific character while business crimes investigation. Such examinations are: forensic technological examination, forensic merchandising examination, forensic chemical examination, forensic account examination and some other. Important circumstances for crime detection are clarified by execution of mentioned examinations.

Рассмотрены особенности расследования преступлений в сфере экономической деятельности по новому КПК Украины. Показана специфика проведения следственного осмотра места происшествия, допроса (свидетеля, подозреваемого, обвиняемого, подсудимого, эксперта), обыска, следственного эксперимента, подготовки и проведения экспертиз (судебно-технологической, судебно-товароведческой, судебно-химической, судебно-бухгалтерской).
