Деякі питання вдосконалення взаємодії слідчого з працівниками експертно-криміналістичних установ в умовах дії нового Кримінального процесуального кодексу України

Abstract

Розглянуто особливості взаємодії слідчого як представника з боку обвинувачення з іншими учасниками кримінального провадження, такими як експерт, спеціаліст та ін. Проаналізовано наукову літературу з цієї проблеми. Обґрунтовано, що на сьогодні законодавством неповністю врегульовані питання взаємодії слідчого з працівниками експертно-криміналістичних підрозділів. Запропоновано нові форми взаємодії.The article deals with peculiarities of the investigator’s interactions as the representative of the prosecution with other participants of the criminal proceedings, namely an expert and specialist. The article analyzes legal publications on the investigator’s powers as an independent officer of law and his interactions with other parties to criminal proceedings. It proves that at present the legislation does not provide the comprehensive regulation of issues related to the investigator’s interaction with the expert and criminalistic institution personnel. The article also brings focus to the changes in the national criminal procedure law that condition new approaches to analyzing the interactions between the investigator and the expert and criminalistic institution personnel while conducting pretrial investigations. It provides for the necessity of the further study into scientifically reasoned ways for its improvement and development. The article suggests adding to the new Criminal Procedure Code of Ukraine a definition of the notion «special knowledge» and provide for criminal liability of an expert for intentionally giving false testimony and obstructing the establishment of truth in criminal proceedings.Рассмотрены особенности взаимодействия следователя как представителя со стороны обвинения с другими участниками уголовного производства, такими как эксперт, специалист и др. Проанализирована научная литература по этой проблеме. Обосновано, что на сегодня законодательством неполностью урегулированы вопросы взаимодействия следователя с сотрудниками экспертно-криминалистических подразделений. Предложены новые формы взаимодействия.
