Протидія криміногенним впливам засобів масової інформації Національною поліцією України

Abstract

Розглянуто вплив засобів масової інформації на населення. Зазначено, що саме вони стали і джерелом, і знаряддям дії на населення, визначають критерії оцінки добра і зла, формують стереотипи поведінки. Визначено поняття «протидія криміногенним впливам засобів масової інформації Національною поліцією України». Проаналізовано положення кримінального і адміністративного законодавства щодо протидії криміногенним впливам ЗМІ Національною поліцією.The purpose of these papers is to identify and analyze the counteraction to criminogenic influences of mass media by the National Police of Ukraine. The negative impact of mass media on the population is considered. It is determined that they have become both a source and an instrument of action on the population, determine the criteria for assessing good and evil, form stereotypes of behavior. Often these sources are filled with images of violence and cruelty, racial, national, religious and other types of intolerance, dramatization of the criminal situation, romanticization of criminal activity, harmful lifestyle etc. Together, this has a negative effect on the individual, directs him to the wrong path, causes fear, sows panic, and harms the health of the population. The concept ‘counteraction to criminogenic influences of mass media by the National Police of Ukraine’ is defined. Its content consists of police measures to prevent and stop individuals and society criminalization and victimization by the media. This type of activity is a part of a special counteraction, where the criminal-legal (operational-search and criminal-procedural) response to individuals and society criminalization and victimization by the media is of particular importance. The provisions of the criminal and administrative legislation on counteraction to criminogenic influences of mass media by the National Police are analyzed. It is noted that it occurs mainly within the limits of Articles 161, 295, 299, 300, 301, 301-1, 301-2, 316, 338, 436-1 of the Criminal Code of Ukraine and Articles 173-1, 185-7 of the Code of Administrative Offenses. According to these norms, statistical data are given, which testifies the existence of a procedural mechanism for criminal prosecution.Рассмотрено влияние СМИ на население. Отмечено, что именно они явились и источником, и орудием действия на население, определяют критерии оценки добра и зла, формируют стереотипы поведения. Определено понятие «противодействие криминогенным воздействиям средств массовой информации Национальной полицией Украины». Проанализированы положения уголовного и административного законодательства по противодействию криминогенным воздействиям СМИ Национальной полицией.
