Анотація
Окреслено коло та надано характеристику ключовим принципам правового регулювання оплати праці суддів в Україні. Акцентовано увагу на тому, що не всі із окреслених принципів віднайшли своє
законодавче закріплення, однак при цьому вони витікають із положень
нормативно-правових актів, які в своїй сукупності складають загальне та
спеціальне трудове законодавство, норми якого спрямовано на регулювання
суспільних відносин у відповідній сфері.
The article, based on the analysis of scientific views of scientists and the norms of current legislation, outlined the range and described the key principles of legal regulation of judgesʼ salaries in Ukraine. Emphasis is placed on the fact that not all of the outlined principles have found their legislative consolidation, but they stem from the provisions of regulations, which together constitute general and special labor legislation, the rules of which are aimed at regulating public relations in this area. The monetary incomes of citizens received by them in hryvnias on the territory of Ukraine and which are not of a one-time nature are subject to indexation: pensions; scholarships; wages (cash security); amounts of payments made in accordance with the legislation on compulsory state social insurance, except for monthly insurance payments to victims at work (including payments for necessary care for victims) and members of their families and pensions, which are indexed by law for these types of insurance; the amount of compensation for damage caused to an individual by injury or other damage to health, as well as the amount paid to persons entitled to compensation in case of loss of a breadwinner, except the amount of payments made under the law on compulsory state social insurance; the amount of alimony determined by the court in a fixed amount. It was found that foreign researchers compare the principle of proportionality with the American method of weighing interests, emphasizing some differences in the use of the latter, but does not make a significant difference between these concepts (in particular, the principle of proportionality is considered more structured and scientific, interrelated analytical tests, only the application of the latter – «proportionality in the narrow sense» − similar to the weighing of interests). The method of proportionality in the context of the presented issues provides: first, the remuneration of a judge must correspond to the level of responsibility imposed on him by current legislation; secondly, this principle should be applied in determining the amount of material incentives for judges, as well as in the choice of intangible incentives.
