Публічно-сервісна діяльність Національної поліції України: адміністративно-правові засади : автореферат дисертації

Abstract

Дисертацію присвячено аналізу сутності та особливостей публічно-сервісної діяльності Національної поліції України. Запропоновано авторський підхід до розуміння концепції «сервісної держави». Уточнено місце та особливості Національної поліції в системі суб’єктів публічно-сервісної діяльності. Окреслено ознаки органів Національної поліції, що визначають їх належність до суб’єктів публічно-сервісної діяльності. Доведено, що публічно-сервісна діяльність Національної поліції має широке та вузьке тлумачення. З’ясовано правові засади публічно-сервісної діяльності Національної поліції. Сформульовано авторське визначення поняття «суб’єкт публічно-сервісної діяльності». Окреслено основні завдання органів поліції як суб’єкта публічно-сервісної діяльності. Сформульовано перелік функцій органів поліції як суб’єктів публічної сервісної діяльності та надано їхню характеристику. Окреслено правові інструменти (форми та методи) публічносервісної діяльності Національної поліції. Розкрито особливості здійснення публічної-сервісної діяльності у зарубіжних країнах, а також визначено особливості взаємодії Національної поліції з міжнародними правоохоронними органами з питань публічносервісної діяльності. Надано пропозиції та рекомендації, спрямовані на удосконалення адміністративного законодавства, що регламентує публічно-сервісну діяльність Національної поліції.The thesis is devoted to the analysis of the nature and features of public service activity of the National Police of Ukraine. The author's approach to understanding the concept of "service state" is offered. It is substantiated that the National Police is one of the key subjects of public service activity. It is proposed to consider the public service activity of the National Police in a broad and narrow sense. In the broad sense, the public service activity of the National Police is a purposeful, normatively defined activity of the National Police bodies and divisions aimed at performing both law enforcement and service functions of the state, the content of which is to change the ideology, forms and methods of the latter with the mandatory definition (restriction) of coercive competence only at the legislative level. In the narrow sense, it is an activity aimed at providing administrative services in the field of public safety and order, carried out at the request of individuals and legal entities and aimed at acquiring, changing or terminating rights or duties in the relevant field of public relations. It is emphasized that the content of legal regulation of the public service activity of the National Police is represented by a systematized set of legal acts, a special place among which is occupied by administrative legislation, since the latter determines the specifics of the public service activity of the National Police in the broad and narrow sense and is aimed at creating the necessary legal and technical opportunities to perform the functions assigned to them. It is proved that the guarantees of the implementation of public service activity by police officers are that only with the presence of appropriate legal, organizational, financial, material and technical and other conditions and certain measures, the full, timely and proper execution by policemen of their powers is possible. The features of the implementation of public service activity in foreign countries are revealed, which made it possible to outline promising areas for improving the organization of public service activity by the bodies of the National Police of Ukraine. The features of the interaction of the National Police with international law enforcement agencies on public service activity are determined. It is emphasized that the peculiarity of the implementation of public service powers of the National Police in the field of protection of human rights and freedoms and the interests of the state lies in their temporary nature on the issuance of permits in the field of the permit system.
