Державно-правове регулювання правового режиму іноземців (на матеріалах українських губерній у складі Російської імперії)

Abstract

Досліджено державно-правове регулювання правового режиму іноземців на матеріалах українських губерній у складі Російської імперії. Зазначено, що правове становище іноземних громадян (підданих) визначалось набором окремих юридичних норм, які так і не знайшли своє місце в єдиному нормативно-правовому акті, відтак не були визначені умови в’їзду і виїзду, транзитного проїзду та проживання іноземців. Відсутність єдиного універсального спеціального закону про іноземців не могло забезпечити такий порядок, при якому могли б бути забезпечені узгодженість і ритмічність в управлінні справами іноземних громадян, безперешкодне здійснення всіма учасниками суспільних відносин своїх прав і обов’язків, суспільний і приватний спокій.The scientific article is devoted to the research and complex analysis of the state and legal regulation of the legal regime of foreigners on the materials of the Ukrainian provinces as a part of the Russian Empire. Taking into account the doctrinal study, it was stated that the state and legal regulation of the legal regime of foreigners was ambiguous: on the one hand, merchants from Western Europe introduced the Russian Empire to technical innovations and thus contributed to industrial and economic development; on the other hand, the authorities were very reluctant to let foreigners into their territories, subjecting them to greater restrictions due to the danger of harm to the state, due to religious intolerance of foreigners, distrust of their political beliefs. The legal status of foreigners in the XVIII century determined by the peculiarities of economic development, so the government, interested in development, industry and trade, stimulated the business of foreigners through preferential payment of taxes and duties. In the first, half of the XIX century under the influence of foreign policy factors (the revolution in France and the Napoleonic Wars) was strengthened the legal regime of entry and stay of foreigners with restrictions on movement throughout the country. The legal status of foreign citizens (subjects) within the period under study, continued determined by a set of individual legal norms, which have not found their place in a single legal act, so the conditions of entry and exit, transit and residence of foreigners have not been determined. The absence of a single universal special law on foreigners, in our opinion, could not provide such an order in which could ensure consistency and rhythm in the management of foreign citizens, the unimpeded exercise of all participants in public relations of their rights and responsibilities, public and private peace.Исследовано государственно-правовое регулирование правового режима иностранцев на материалах украинских губерний в составе Российской империи. Отмечено, что правовое положение иностранных граждан (подданных) определялось набором отдельных юридических норм, так и не нашедших свое место в едином нормативно-правовом акте, поэтому не были определены условия въезда и выезда, транзитного проезда и проживания иностранцев. Отсутствие единого универсального специального закона об иностранцах не могло обеспечить такой порядок, при котором могли быть обеспечены согласованность и ритмичность в управлении делами иностранных граждан, беспрепятственное осуществление всеми участниками общественных отношений своих прав и обязанностей, общественное и частное спокойствие.
