Основні нормативно-правові акти, що регулюють діяльність органів Міністерства внутрішніх справ України як суб’єктів забезпечення правопорядку в регіоні

Abstract

Досліджено етимологію та зміст поняття «нормативно-правовий акт», сформульовано авторське визначення цього поняття, виділено групи основних нормативно-правових актів, що регулюють основні нормативно-правові акти, що регулюють діяльність органів Міністерства внутрішніх справ України як суб’єктів забезпечення правопорядку в регіоні.

The author has emphasized on the importance of legal securing the bases of the activities of the agencies of the Ministry of Internal Affairs of Ukraine (MIA) in enforcing the law in the region. Etymology and content of the term «legal act» have been studied. Legal acts that define legal basis of the activities of the agencies of the MIA in enforcing the law in the region have been considered based on their hierarchical structure. It has been proved that the Constitution of Ukraine dated from June 28, 1996 acts as the fundamental legal act having the highest legal force, and which provisions establish legal basis of all subjects of legal life. It has been noted that the Constitutional provisions establish the foundations of legal life, so the agencies of the MIA while enforcing the law in the region are primarily governed by the regulations of the Constitution of Ukraine. The author argues the position that international treaties of Ukraine occupy one of the most important places among legal acts, which assist to determine legal basis of the activities of the agencies of the MIA in enforcing the law in the region. Special attention is paid to the characteristics of the codified legal acts, at the level of which the author has defined legal basis of the activities of the agencies of the MIA as subjects in enforcing the law in the region. The author has grounded the conclusion that at the present time there is an acute problem connected to updating national codified legislation, which establishes the legal basis of the activities of the agencies of the MIA as subjects of enforcing the law. First, it is necessary to adopt new codified act on administrative offences as soon as possible; secondly, there is the need to amend the criminal law to harmonize its provisions.

Исследованы этимология и содержание понятия «нормативно-правовой акт», сформулировано авторское определение этого понятия, выделены группы основных нормативно-правовых актов, регулирующих основные нормативно-правовые акты, регулирующие деятельность органов Министерства внутренних дел Украины как субъектов обеспечения правопорядка в регионе.
