Анотація
Надано характеристику підставам здійснення дисциплінарних
проваджень. З’ясовано сутність, зміст та особливості дисциплінарного
проступку, як ключової підстави дисциплінарного провадження. Досліджено
порядок проведення дисциплінарних проваджень, який регулюється нормами
загального трудового законодавства та положеннями спеціальних
нормативно-правових актів. Виокремлено ключові етапи здійснення
дисциплінарного провадження.
The relevance of the article lies in the fact that ensuring human rights, freedoms and interests in the field of labor is an important task of the domestic legislator. For this purpose, the state mechanism has a large number of tools, among which disciplinary proceedings have an important place. The latter is a guarantee that the fact of violation of labor discipline by the employee will be established in full, and the measures of disciplinary influence applied to him, in particular, dismissal, will have an objective nature corresponding to the degree of guilt. That is, disciplinary proceedings do not simply declare the need to conduct an analysis of each individual case of violation of labor discipline, but represent the employer’s duty to make a decision on a negative change in the employee’s status and restriction of his rights only in the case of establishing objective reasons, conditions and circumstances of committing a disciplinary offense. At the same time, disciplinary proceedings must be carried out in a clearly defined manner and in the presence of certain grounds and conditions. The article, based on the analysis of scientific views of scientists and the norms of current legislation, describes the grounds for disciplinary proceedings. The essence, content and features of disciplinary misconduct as a key basis for disciplinary proceedings are clarified. The procedure for conducting disciplinary proceedings, which is regulated by the norms of general labor legislation and the provisions of special regulations, has been studied. The key stages of disciplinary proceedings are highlighted. It was concluded that the stages of conducting disciplinary proceedings need regulatory consolidation, which should be more formalized and include: a) obtaining information about a disciplinary offense and discovery based on this disciplinary proceeding; b) taking written explanations from the employee, as well as witnesses of the employee committing a disciplinary offense; c) receiving explanations from persons (if available) who deny information about the employee committing a disciplinary offense; d) issuance of an order to terminate disciplinary proceedings, in the event of failure to confirm information about a disciplinary offense or an order to apply disciplinary sanctions.
