dc.description.abstractВідображено результати комплексного аналізу законодавства України, що становить правову основу використання підрозділами карного розшуку оперативно-розшукового заходу «розвідувальне опитування». Розглянуто закономірності взаємозв’язку нормативноправової бази з практикою застосування розвідувального опитування. Вироблено на цій основі пропозиції щодо вдосконалення законодавчого забезпечення.
dc.description.abstractThe modern features of legal regulation of conducting reconnaissance survey by criminal investigation divisions are researched. The theme of the paper is peculiarities of legal regulation of conducting reconnaissance survey by criminal investigation divisions. The Objective of the paper is to research modern peculiarities of legal regulation of conducting reconnaissance survey by criminal investigation divisions. Methods of the research are comparative, formal and logical. The relevance of the paper is determined by insufficient elaboration of regulatory gaps within criminal investigation divisions’ activity while conducting reconnaissance survey. Results of the research are the conclusions about the gaps and ways of their solving in terms of the chosen issue. The area of implementation is operative and search activity, criminal procedure, criminalistics. The practical importance of the paper is the fact that some provisions of the article may be used while writing monographs, educational and methodical textbooks. Conclusions: the author during the research singled out the main features of the term «reconnaissance survey» within operative and search activity, which must be necessarily taken into account in determining this term, namely the legal basis, survey subjects, the purpose, the nature of received information. It is also concluded that the operative and search measure «reconnaissance survey» does not limit the rights and freedoms of citizens, has no procedural and other compulsion (not infringe and does not restrict security of persons against whom there is a special procedure for conducting operative and search activity) and may be conducted without limitation in respect to any category of persons.
dc.description.abstractОтражены результаты комплексного анализа законодательства Украины, составляющего правовую основу использования подразделениями уголовного розыска оперативно-розыскного мероприятия «разведывательный опрос». Рассмотрены закономерности взаимосвязи нормативно-правовой базы с практикой применения разведывательного опроса. Выработаны на этой основе предложения по совершенствованию законодательного обеспечения.
