До характеристики завдань державної служби правоохоронного характеру

Abstract

Окреслено коло завдань державної служби правоохоронного характеру. Наголошено, що ті завдання, які ставляться перед службами правоохоронного характеру залежать від сучасних реалій, цілей та пріоритетів, які ставить перед собою держава, серед яких можна виділити потреби та інтересів суспільства, його економічних можливостей, професіоналізму державних службовців і структур та ін. Підкреслено,що завдання державної служби правоохоронного характеру - це основні мікроцілі організації та діяльності державних органів, в основу діяльності яких покладено гарантування безпеки та захисту конституційних прав, свобод і законних інтересів людини та громадянина, держави та суспільства загалом, з відновленням їх прав та інтересів у разі порушення, а також відстоювання територіальної цілісності та суверенітету держави.

The relevance of the article is that the law enforcement function, as a direction of the state, is aimed at solving the main tasks related to ensuring the protection of the constitutional order, rights and freedoms of citizens, law and order proclaimed by the Constitution of Ukraine. Therefore, for the normal functioning of the state, its full implementation of its tasks and the realization of fundamental human rights and freedoms, life and health, honor and dignity, inviolability and security, state bodies are created, which are part of the state mechanism. The essence of any object, subject or phenomenon is determined in the process of establishing the purpose and objectives of its creation and operation. They are the basis that provides analysis of the peculiarities of a particular phenomenon, its interaction with other categories and place in the system of concepts. The value of the categories “purpose and task” is manifested both in the characterization of the real actions of the subjects of legal regulation, and in clarifying the relationship between the rules of law, legal relations, legal acts in a particular social context. The article, based on the analysis of scientific views of scientists and current legislation, outlines the range of tasks of the civil service of law enforcement. It is emphasized that the tasks set before law enforcement agencies depend on modern realities, goals and priorities set by the state, among which are the needs and interests of society, its economic opportunities, professionalism of civil servants and structures, etc. It is determined that the main tasks of the law enforcement system in general should include the following: protection of the constitutional order, sovereignty and territorial integrity of the state; ensuring and protecting the rights and freedoms of man and citizen, the interests of society and the state as a whole from unlawful encroachments; combating and combating crime, using measures to detect, prevent and stop crimes; promoting the improvement of the entire legal system of Ukraine, both national legislation and in the field of civil service of law enforcement, the activities of which are aimed at fulfilling the function of the state (including law enforcement).

Обозначен круг задач государственной службы правоохранительного характера. Отмечено, что задачи, которые ставятся перед службами правоохранительного характера, зависят от современных реалий, целей и приоритетов, которые ставит перед собой государство, среди которых можно выделить потребности и интересы общества, его экономические возможности, профессионализм государственных служащих и структур. Подчеркнуто, что задачи государственной службы правоохранительного характера - это основные микроцели организации и деятельности государственных органов, в основу деятельности которых положено обеспечение безопасности и защиты конституционных прав, свобод и законных интересов человека и гражданина, государства и общества в целом, с восстановлением их прав и интересов в случае нарушения, а также отстаивания территориальной целостности и суверенитета государства.
