Поняття принципів відшкодування шкоди у трудовому праві України

Abstract

Розкрито сутнісний зміст поняття «принцип». Запропоновано авторське визначення поняття принципів відшкодування шкоди у трудовому праві України. Аргументовано, що принципи в контексті представленої проблематики покликані забезпечувати ідейну основу функціонування механізму відшкодування шкоди у трудовому праві, його загальне спрямування та ключові пріоритети. Зроблено висновок, що принципи являють собою не просто найбільш загальні положення, які покладені в основу права, – це закономірності суспільного життя, що сформувалися в наслідок його об’єктивного розвитку, які були виявлені та науково обґрунтовані людиною як найбільш корисні та доцільні для використання у існуючому правову просторі.

The relevance of the article lies in the fact that when studying the legal regulation of certain relations of social life, it is important to consider the principles on which this regulation is based. The above certainly applies to the relations of compensation for damages in labor law, which are based on general and special principles. This is explained by the fact that the principles do not simply form the basis, the basic idea of the functioning of certain legal relations, it is with their help that the laws of further development and improvement of the institution of compensation for damages in the labor law of Ukraine are formed. Therefore, the study of principles has important theoretical and practical significance. The article, based on the analysis of scientific views of scientists, reveals the essential meaning of the concept of "principle". The author's definition of the concept of compensation principles in the labor law of Ukraine is proposed. It is argued that the principles in the context of the presented issues are intended to provide the ideological basis for the functioning of the compensation mechanism in labor law, its general direction and key priorities. It was concluded that the principles are not just the most general provisions that are the basis of law, they are the regularities of social life that were formed as a result of its objective development, that were discovered and scientifically substantiated by man as the most useful and expedient for use in the existing legal space. Therefore, the special importance of the principles of law lies in the fact that they express the key, most general and universal laws in a concentrated form, which constitute the ideological basis of both law as a whole and its individual elements (branches, institutions, norms). Due to their generality, universality, relative immutability and imperativeness, they ensure the corresponding single focus of legal life in the state. The above fully applies to the principles of compensation for damages in the labor law of Ukraine, which represent the most general and universal ideas, basic, indisputable provisions that form the basis of the organization and functioning of the legal mechanism for compensation for damages. The principles are designed to provide the ideological basis of the mentioned mechanism, its general direction and key priorities.

Раскрыто сущностное содержание понятия «принцип». Предложено авторское определение понятия принципов возмещения вреда в трудовом праве Украины. Аргументировано, что принципы в контексте представленной проблематики призваны обеспечивать идейную основу функционирования механизма возмещения вреда в трудовом праве, его общую направленность и ключевые приоритеты.
