dc.description.abstractВиявлено особливості виконання договору про надання юридичних послуг. Наголошено, що виконання договору – це динамічний стан зобов’язання, завдяки якому здійснюються права та виконуються обов’язки сторін зобов’язання. Цей договір не може містити такого застереження як «гарантія виграшу судової справи», оскільки відповідна умова фактично вводить в оману замовника, а досягнення цього результату не залежить тільки від професійності, сумлінності, здібностей виконавця та його діяльності взагалі. Результат сам по собі не може виступати критерієм якості наданих юридичних послуг. Замовник є слабкою стороною за договором про надання юридичних послуг, що вимагає додаткового забезпечення прав та інтересів цього суб’єкта. Через це на нормативному рівні запропоновано закріпити критерії якості наданих виконавцем юридичних послуг.uk_UA
dc.description.abstractThe article is focused on identifying specifi c features of the enforcement of the contract on the provision of legal services. It has been emphasized that the enforcement of the contract is a dynamic state of the obligation, which assists in realizing the rights and fulfi lling obligations by the parties to the obligation. If the obligation is a legal relationship in statics, then its fulfi llment is a dynamic state of the obligation, which facilitates the realization of the rights and fulfi llment of the obligations by the parties to the obligation. Actions performed by the provider of services under the contract are legal services. The contract for the provision of legal services is fi duciary in its essence, the one that is based on personal and trustworthy relationships between the founder and the provider of services. The personality of the provider of services acquires signifi cant importance for the customer of legal services. The customer must be sure of the services provider’s fairness, the correctness of his actions, as well as his professionalism. The contract on the provision of legal services cannot contain such a caution as “guarantee of winning a suit”, since the corresponding condition actually misleads the customer, and the achievement of this result does not depend only on the professionalism, integrity, abilities of the services provider and his activities in general. The result itself cannot be a criterion for the quality of the provided legal services. Although it is not the obstacle for establishing additional reward in the researched contract to the provider of services for achieving a positive result for the customer – the so-called “contingency fee”, the calculation and payment of which depends on the happening of a certain event. The amount of the “contingency fee” must meet the criterion of reasonableness, on the basis of specifi c circumstances of the case and the fi nancial situation of both parties in order to prevent abuse by the provider of legal services. The provision of legal services is covered by conducting defence, representing interests in the court, providing other types of legal aid to the customer. The customer is a weaker party under the contract on the provision of legal services, who requires additional protection of the rights and interests of this subject. That is the reason for consolidating the quality criteria of provided legal services at the regulatory level.uk_UA
dc.description.abstractВыявлены особенности выполнения договора о предоставлении юридических услуг. Подчеркнуто, что исполнение договора – это динамическое состояние обязательства, благодаря которому осуществляются права и исполняются обязанности сторон обязательства. Настоящий договор не может содержать такой оговорки как «гарантия выигрыша судебного дела», поскольку соответствующее условие фактически вводит в заблуждение заказчика, а достижение этого результата не зависит только от профессионализма, добросовестности, способностей исполнителя и его деятельности вообще. Результат сам по себе не может выступать критерием качества предоставленных юридических услуг. Заказчик является слабой стороной по договору о предоставлении юридических услуг, что требует дополнительного обеспечения прав и интересов этого субъекта. На нормативном уровне предложено закрепить критерии качества предоставляемых исполнителем юридических услуг.uk_UA
