Суб’єкти кадрового забезпечення Державної митної служби України та межі їх компетенції

Abstract

У статті, спираючись на аналіз наукових поглядів вчених, запропоновано авторське визначення поняття «кадрове забезпечення Державної митної служби України». Розкрито положення норм чинного законодавства України, норми яких спрямовані на врегулювання діяльності Державної митної служби України взагалі та кадрового забезпечення даного відомства, зокрема. З’ясовано, що під суб’єктами кадрового забезпечення Державної митної служби України найбільш доцільно розуміти спеціально уповноважені фізичні та/або юридичні особи, які відповідно до норм чинного законодавства наділені певним колом суб’єктивних прав та юридичних обов’язків, які дозволяють їм вступати у правові відносини в досліджуваній сфері. Встановлено, що кадрове забезпечення Державної митної служби України залежить від діяльності великого числа різноманітних суб’єктів: органів державної влади та їх посадових осіб, кожен з яких володіє власними повноваженнями у відповідній сфері.It has been found that under personnel support subjects of the State Customs Service of Ukraine it is most expedient to understand specially authorized physical and/or legal persons who, in accordance with the norms of the current legislation, are endowed with a certain range of subjective rights and legal obligations that allow them to enter in legal relations in the researched area. It has been established that the staffing of the State Customs Service of Ukraine depends on the activities of a large number of various subjects: state authorities and their officials, each of whom has his own powers in the relevant field. At the same time, the rights and obligations of all subjects are different in scope and target orientation, in connection with which it is proposed to classify them as follows: 1) subjects responsible for the formation of the legislative framework and state policy in the field of personnel support of the State Customs Service (the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, the Ministry of Finance of Ukraine); 2) subjects whose competence includes the general organization, coordination and implementation of personnel support in the State Customs Service (Head of the State Customs Service of Ukraine, Department of Personnel); 3) subjects of human resources in the structural divisions of the State Customs Service - heads of territorial bodies of the State Customs Service. It is summarized that each of the subjects outlined above has its own, special legal status and acts within the limits of the norms of the current legislation and the departmental legal framework of competence. The latter, in turn, is determined by: first, the norms of the current legislation, which regulates the activity of this or that subject; secondly, the powers granted to relevant subjects in the process of staffing; thirdly, the purpose, tasks and functions that they perform in the process of implementing the corresponding provision.В статье, опираясь на анализ научных взглядов ученых, предложено авторское определение понятия "кадровое обеспечение Государственной таможенной службы Украины". Раскрыты положения норм действующего законодательства Украины, нормы которых направлены на урегулирование деятельности Государственной таможенной службы Украины и кадрового обеспечения данного ведомства, в частности. Установлено, что кадровое обеспечение Государственной таможенной службы Украины зависит от деятельности большого числа различных субъектов: органов государственной власти и их должностных лиц, каждый из которых владеет своими полномочиями в соответствующей сфере.
