Історико-правовий огляд взаємодії органів охорони правопорядку з громадськістю

Abstract

Досліджено історико-правовий досвід взаємодії поліції та громадянського суспільства, з метою аналізу реформування партнерських стосунків правоохоронних органів та громадськості для виявлення та усунення прогалин у вказаних відносинах. Наголошено, що у сфері забезпечення внутрішньої безпеки та охорони правопорядку громадянське суспільство вступає у взаємодію з поліцією, яка лише за підтримки громадськості може успішно здійснювати боротьбу зі злочинністю та захищати права і свободи особи.

The coexistence of the state and civil society institutions acts as a complex process of mutual control and mutual restriction. In a state governed by the rule of law, the self-organization of society acquires a normative basis and law is the main regulator of relations between the state and civil society institutions. The model of partnership becomes the optimal model of relations between the state and civil society institutions. Cooperation of this type contributes to the effective implementation of public policy and the effective implementation of public functions, an important place among which is the law enforcement function. Close interaction, interaction and control of the state and civil society in the face of its institutions contribute to the effective implementation of the law enforcement function of the state, rapprochement of the population and government, resolving contradictions in the social and state-legal spheres. The interaction of the police and citizens in the fight against crime is becoming an attribute of modern democracies, and new forms and new directions of partnership between the state and society in the fight against crime – the realities of political and legal organization. This article is aimed at studying the historical and legal foundations of the emergence and development of partnerships between society and law enforcement agencies in different periods of time. The analysis of which will make it possible to improve the current rules governing the partnership between society and the police, at present.

Исследован историко-правовой опыт взаимодействия полиции и гражданского общества с целью анализа реформирования партнерских отношений правоохранительных органов и общественности для выявления и устранения пробелов в указанных отношениях. Отмечено, что в сфере обеспечения внутренней безопасности и охраны правопорядка гражданское общество вступает во взаимодействие с полицией, которая только при поддержке общественности может успешно бороться с преступностью и защищать права и свободы личности.
