Поняття та особливості правоохоронної функції держави

Abstract

З’ясовано зміст поняття та окреслено особливості правоохоронної функції держави. Наголошено, що правоохоронна функція держави необхідна для охорони правопорядку, прав і свобод особистості, власності, тобто є комплексною і надзвичайно широкою за обсягом категорією.

The relevance of the article is that today, in the light of all the events that the state is experiencing, new and strengthened priorities and directions of its activities are emerging. One of the defining areas is the protection and proper provision of human and civil rights and freedoms, which leads to the problem of separation of law enforcement functions of the state. Since the functions of the state express the social nature of the state and concretize its essence, which requires the development of new approaches to their understanding and definition of its features. The grouping of state functions into different types depends on many factors and can be carried out in various areas, which emphasizes the lack of a unified approach to the classification of state functions and leads to their branching, covers their individual names, understanding their content and meaning, and leads to uncertainty. ‘language. Turning to the definition of the law enforcement function of the state, we believe that it can be confidently attributed to the main internal permanent functions of the state, but in terms of its interpretation, there is no single point of view among scholars. The article, based on the analysis of scientific views of scientists, formed the author’s approach to the interpretation of the law enforcement function of the state. The list of the most important characteristic features of this scientific category is singled out. It is generalized that the law enforcement function of the state is necessary for the protection of law and order, rights and freedoms of the individual, property, ie is a complex and extremely broad category. It was found that among scholars and practitioners there is no single approach to defining the law enforcement function of the state as one group of scientists is inclined to believe that it is primarily a function of protecting law and order and protection of human and civil rights and freedoms; the second group of scientists believes that this is the function of protecting law and order, legality and various forms of ownership; the third group of scientists perceives the law enforcement function as a system of necessary resources provided with a comprehensive direction of the state, which operates on the basic principles of social and legal state and is designed to prevent violations of fundamental human and civil rights and freedoms.

Выяснено содержание понятия и определены особенности правоохранительной функции государства. Отмечено, что правоохранительная функция государства необходима для охраны правопорядка, прав и свобод личности, собственности, то есть комплексной и чрезвычайно широкой по объему категории.
