Анотація
У статті розглянуто питання сучасних викликів та проблем, пов’язаних з організацією та функціонуванням служби в органах місцевого самоврядування, дослідження спрямоване на аналіз адміністративно-правового регулювання службових відносин в органах місцевого самоврядування в умовах дії правового режиму воєнного стану. У статті автор досліджує зміни у трудовому законодавстві, які відбулися у зв’язку із запровадженням воєнного стану, шляхи практичної реалізації таких змін, та проблемні питання з якими стикаються на практиці роботодавці та працівники.
The military aggression of the Russian Federation, the occupation of the territories of Ukraine, the introduction of martial law throughout the territory of Ukraine posed many difficult challenges for the state authorities, including for the legislator. People's deputies faced the extremely difficult task of regulating labor and service relations in the languages of martial law. Regulate relations in cases where the employer's enterprise has suffered terrible damage, when employees have left their homes to save their lives and the lives of their children, when local government officials have left the occupied territory by any means, each described situation is unique and complex, and one that requires settlement at the legislative level. The legislator tried to settle these issues, but the current regulations need research and improvement. The article examines the issue of modern challenges and problems related to the organization and functioning of the service in local self-government bodies, the research is aimed at the analysis of administrative and legal regulation of service relations in local self-government bodies under the conditions of the legal regime of martial law. In the article, the author examines the changes in labor legislation that took place in connection with the introduction of martial law, the ways of practical implementation of such changes, and the problematic issues faced by employers and employees in practice. The conclusions obtained as a result of the conducted research will contribute to the formation of a scientific and practical understanding of ways to improve service in local self-government bodies in Ukraine under martial law. The results of the study can be used in the process of developing and implementing reforms aimed at improving the organization and functioning of the service in local self-government bodies in Ukraine under the legal regime of martial law. The problematic issues of Ukrainian realities are examined in detail through the prism of a number of innovations, and problematic issues faced by employers when implementing the newly introduced legal norms are highlighted.
В статье рассмотрены вопросы современных вызовов и проблем, связанных с организацией и функционированием службы в органах местного самоуправления, исследование направлено на анализ административно-правового регулирования служебных отношений в органах местного самоуправления в условиях действия правового режима военного положения. В статье автор исследует изменения в трудовом законодательстве, которые произошли в связи с введением военного положения, пути практической реализации таких изменений и проблемные вопросы, с которыми сталкиваются на практике работодатели и работники.
