Поняття та зміст принципів правового регулювання кар'єрного росту поліцейських

Abstract

Здійснено аналіз наукових підходів стосовно сутності таких понять, як: «принципи» та «принципи права», на основі чого запропоновано авторське визначення «принципів правового регулювання кар’єрного росту поліцейських». Зазначено, що принципи правового регулювання кар'єрного росту поліцейських представляють собою вихідні начала, відправні ідеї, які лежать в основі здійснення відповідного нормативно-правового регулювання та дотримання яких є обов’язковим для всіх учасників відповідних правовідносин. Здійснено класифікацію принципів та надано їм змістовну характеристику. Обґрунтовано доцільність законодавчого закріплення принципів правового регулювання кар'єрного росту поліцейських.

The relevance of the article lies in the fact that, despite the individuality of all legal systems, legal principles are the basis of the structure of each of them. The latter play the role of starting points, generally accepted social guidelines that do not change over time and ensure the functioning of legal categories, institutions, and so on. In fact, the principles direct the mechanisms of legal regulation of social relations. They are inherent to everyone without exception of legal phenomena, among which the career growth of police officers is not an exception, the various stages of which are regulated by a large number of regulatory and legal acts. The article analyzes scientific approaches to the essence of such concepts as: "principles" and "principles of law", on the basis of which the author's definition of "principles of legal regulation of the career growth of police officers" is proposed. The principles outlined in the article were classified and given a meaningful description. Reasoned expediency of legislative consolidation of the principles of legal regulation of career growth of police officers. In the aspect of legal regulation of the career growth of employees of the National Police of Ukraine, the principle of equality is revealed in several aspects at once. First, every police officer cannot be limited in his labor rights during promotion due to any subjective factors, except those that, according to the legislation of Ukraine, hinder his career growth. Secondly, no police officer can have priority in his career growth compared to other employees of the bodies and divisions of the National Police of Ukraine, except on the basis of objective factors, which include, for example, the level of education, health status, etc. other According to the principle of unlimitedness, the career of a police officer should be a continuous process that cannot be limited by anything or anyone. That is, using the available skills, knowledge, physical and psychological capabilities, every police officer has the right to reach the highest management levels of the police structure. The exception is limiting factors that are directly provided for by the legislation of Ukraine, for example, a police officer committing a disciplinary offense that prevents him from being appointed to a higher position within a certain period.

Осуществлен анализ научных подходов относительно сущности таких понятий, как «принципы» и «принципы права», на основе чего предложено авторское определение «принципов правового регулирование карьерного роста полицейских». Отмечено, что принципы правового регулирования карьерного роста полицейских представляют собой исходные начала, идеи, лежащие в основе осуществления соответствующего нормативно-правового регулирования и соблюдение которых обязательно для всех участников соответствующего правоотношения. Осуществлена ​​классификация принципов и дана им содержательная характеристика. Обоснована целесообразность законодательного закрепление принципов правового регулирования карьерного роста полицейских.
