Анотація
У статті, спираючись на аналіз наукових поглядів вчених, надано характеристику системі правоохоронних органів України. Розкрито положення норм чинного законодавства, які спрямовані на регулювання діяльності
Державного бюро розслідувань як особливого правоохоронного органу України. Виокремлено
ключові особливості ДБР, які характеризують дане відомство як правоохоронний орган.
It is argued that the State Bureau of Investigation has all the characteristics that are inherent in law enforcement agencies, in particular: 1) the legislative definition of the Bureau as a law enforcement agency; 2) its activity is ensured by a number of regulatory and legal acts of different legal force, the violation of which leads to the onset of the corresponding type of legal responsibility; 3) officials of the SBI have a number of powers aimed at the implementation of tasks in the field of law enforcement assigned to this institution. It was noted that the place of the State Bureau of Investigations in the system of law enforcement bodies of Ukraine is determined by: first, the provision of Article 1 of the Law “On the State Bureau of Investigations”, which directly establishes that the SBI is a law enforcement body; secondly, the purpose of its operation is the implementation of operational and investigative activities and pretrial investigation of special types of crimes; thirdly, the strengthening of the fight against the violation of anti-corruption legislation at the highest levels of the state administration, which corresponds to the European choice of the development path of Ukraine. It is summarized that the features of the SBI as an element of the system of law enforcement bodies are that it has a highly specialized law enforcement focus. At the same time, the importance of the bureau’s activity in the middle of this system is related to the importance of the role it plays in ensuring the normal functioning of the state apparatus. This is due to the fact that the activity of the State Bureau of Investigation covers the implementation of a wide range of law enforcement functions (prevention, detection, termination, disclosure and investigation of criminal offenses) in relation to a narrow circle of subjects defined by legislation, which have a significant impact on political, social, economic and other elements national security of the country. The features of the Bureau also include: a strengthened mechanism of democratic civil control, which is designed to ensure legality, efficiency, impartiality and transparency in its activities; the presence of special officials in other law enforcement agencies, whose functional duties include interaction with the SBI; the presence of a special approach to the management of the investigated department.
В статье, опираясь на анализ научных взглядов ученых, дана характеристика системе правоохранительных органов Украины. Раскрыты положения норм действующего законодательства, направленные на регулирование деятельности Государственного бюро расследований как особого правоохранительного органа Украины. Выделено ключевые особенности ГБР, характеризующие данное ведомство как правоохранительный орган.
