Договір як загальноправова категорія

Abstract

Надано характеристику договору як загальноправової категорії. Виокремлено риси, які відрізняють договори від інших нормативно-правових актів. Висвітлено структурні ознаки договору.

The author analyzes new approaches of understanding the concept «contract». The notion of a contract in the broad sense is studied. The objective of this article is the analysis of the modern definitions that have emerged in the jurisprudence concerning the content of a contract’s notion as the general and legal category. The methodological basis of the work is the complex of philosophical and scientific methods of cognition. Dialectical and philosophical method has been used in the research. A contract has been considered in the development and relation to other phenomena with the help of this method that has revealed their content and form of existence. Usage of the historical method made it possible to study the genesis and issues of a contract’s development and its interpretation. Qualitative characteristics of a contract are established. The author defines the features that distinguish the creation of regulatory agreements on the creation of legal acts. It is stressed that a contract in its broadest sense as a legal act executes demonstration and consolidation of a separate coordinated autonomous will of two or more formally equal subjects of law, creates their mutual legal rights and duties, which are characterized by obligatory performance.

Дана характеристика договора как общеправовой категории. Определены черты, отличающие договора от других нормативно-правовых актов. Освещены структурные признаки договора.
