Сутність та зміст ключових функцій керівника Державного бюро розслідувань як суб’єкта забезпечення дисципліни та законності

Abstract

У статті, спираючись на аналіз наукових поглядів вчених та норм чинного законодавства, виокремлено наступні ключові функції керівника Державного бюро розслідувань як суб’єкта забезпечення дисципліни та законності: організаційно-розпорядчу; контрольно-спостережну; аналітико-планувальну; та інноваційну. Надано змістовну характеристику кожній із виділених функцій. Наголошено на необхідності їх законодавчого закріплення.The following key functions of the head of the State Bureau of Investigation as a subject of ensuring discipline and legality are highlighted and characterized: organizational and management; control and observation; analytical and planning; and innovative. It is argued that in the context of ensuring legality and discipline in the SBI, the organizational and administrative function of the head involves the use of the powers and offi cial legal status granted to him by the latter in order to: a) establish the effective and high-quality work of the Bureau and each individual body and unit that is part of its structure; b) establishment of cooperation mechanisms of structural components of the Bureau, including issues of ensuring discipline and legality; c) determination of priorities and requirements for the activity of the personnel of the law enforcement body in terms of compliance with the requirements of regulatory acts of a departmental nature; d) issuance of local regulatory documents on the implementation of labor rights and responsibilities of subordinate personnel, improvement of the state of offi cial discipline, response to violations of the rule of law It is summarized that planning and analytics are complementary directions in the fi eld of ensuring legality and discipline in the SBI. In particular, the fi rst one allows for systematic processing of information about the state of discipline and legality in bodies and units of the SBI; the number of violations committed by the staff of the Bureau; the scope of implemented measures to overcome negative factors that affect the deterioration of the state of discipline and legality; resource and personnel capabilities of bodies and subdivisions of the SBI as a whole, etc. In turn, planning allows, on the basis of analytical information, to determine measures and procedures aimed at improving and strengthening legality and discipline in the future. It has been proven that the innovative function of the head, as a subject of ensuring legality and discipline in the State Bureau of Investigation, consists in a systematic and relentless search for ways and models of improving the activity of the investigated department, which involves the following: studying international experience on the specifi ed issue; conducting theoretical and legal research in the relevant direction and using their results in the practical work of the SBI; consideration and use of modern assets of science and technology, etc.В статье, опираясь на анализ научных взглядов ученых и норм действующего законодательства, выделены следующие ключевые функции руководителя Государственного бюро расследований как субъекта обеспечения дисциплины и законности: организационно-распорядительную; контрольно-наблюдательную; аналитико-планировочную; инновационную. Дана содержательная характеристика каждой из выделенных функций. Отмечена необходимость их законодательного закрепления.
