Становлення та розвиток законодавства у сфері захисту трудових прав державних службовців: з часів існування СРСР до сьогоднішнього дня

Abstract

Здійснено історико-правовий аналіз становлення та розвитку законодавства у сфері захисту трудових прав державних службовців з часів існування СРСР до сьогоднішнього дня. Констатовано, що законодавство у сфері захисту трудових прав всіх категорій працівників, в тому числі і державних службовців, має досить тривалу історію розвитку, однак при цьому відмічено, що говорити про те, що цей процес є завершеним ще занадто рано, адже у вказаній сфері залишається низка прогалин і недоліків.

The relevance of the article is that the protection of labor rights of civil servants is an urgent problem that needs to be addressed in the context of reforming the civil service and labor legislation of Ukraine. After all, in the face of such changes in national legislation, there is a tendency to prioritize the interests of the state over the legitimate interests of civil servants. Given the urgency of this problem, the study of the genesis of legislation in the field of protection of labor rights of civil servants will provide an opportunity to distinguish the stages of development of legislation in this area and identify some of its shortcomings that need to be addressed in the future. The purpose of the article is to find out how the development of legislation in the field of protection of labor rights of civil servants from the time of the USSR to the present day. The article, based on the analysis of scientific views of scientists and regulations that operated in different historical periods, analyzes the formation and development of legislation in the field of protection of labor rights of civil servants from the time of the USSR to the present day. It is stated that the legislation in the field of protection of labor rights of all categories of workers, including civil servants, has a long history of development, but it is noted that to say that this process is completed too early, because in this area remains a number of gaps and shortcomings. It is concluded that the legislation in the field of protection of labor rights of all categories of workers, including civil servants, has a long history of development. However, it is too early to say that this process has been completed, as there are a number of gaps in this area. In particular, given the above, it can be concluded that it is necessary to expand the list of labor rights of civil servants, in connection with which appropriate amendments should be made to the Law of Ukraine «On Civil Service» and the Labor Code of Ukraine.

Проведен историко-правовой анализ становления и развития законодательства в сфере защиты трудовых прав государственных служащих со времен существования СССР до сегодняшнего дня. Констатировано, что законодательство в сфере защиты трудовых прав всех категорий работников, в том числе и государственных служащих, имеет достаточно длительную историю развития, однако при этом отмечено, что говорить о том, что этот процесс завершен еще слишком рано, ведь в указанной сфере остается ряд пробелов и недостатков.
