Правова природа фінансових інтересів держави в бюджетному процесі в Україні

Abstract

Досліджено фінансові інтереси держави в сучасних умовах правового регулювання бюджетного процесу в Україні. Проаналізовано сучасні наукові дослідження щодо публічності фінансових правовідносин. Доведено публічний характер державних та місцевих фінансових інтересів. Розглянуто фінансові інтереси держави, пов’язані з формуванням, розподілом та використанням бюджетних фондів і реалізуються на всіх рівнях бюджетної системи в діяльності учасників бюджетного процесу при здійсненні витрат з бюджету. Визначено правові засоби забезпечення державних фінансових інтересів, які залежать від обсягів, цілей і спрямованості бюджетного фінансування.

Financial interests of the state in modern conditions of the organization of the budget process in Ukraine are studied. The author has analyzes the importance of financial interests of the state, local governments within the budgetary activities and legal means of guaranteeing financial interests of the state both at the state and local budgets, which must be fully satisfied in accordance with the amount of funds approved by the budget law or decision o about local budget. It is proved that with the reform of political and economic relations in Ukraine public interests in financial activities are not limited by the expenses from the State Budget of Ukraine, but cover the financial interests of local governments, local communities and other entities of financial relations like their equal participants. Considering the fact that there is no common approach to establish the types of public interest in the budget process within the modern legal doctrine, the author considers the essence of the category «financial interests of the state» and defines its public character. Financial interests in the budget process are related to the formation, distribution and use of budgetary funds and are implemented at all levels of budget system within the activities of the participants of the budget process while realizing the budget expenditure. It is proved that financial interests in the budget process always have a public character and are detailed with the set of actions of the participants of the budget process in accordance with their authorities established by the budget legislation related to the formation and the efficient, effective and targeted use of budget funds. It is determined that the legal means of guaranteeing the state financial interests depends on the scope, objectives, focus of the budget funding, which are set by the budget legislation.

Исследованы государственные финансовые интересы в современных условиях организации бюджетного процесса в Украине. Проанализированы современные научные исследования о публичности финансовых правоотношений. Доказан публичный характер государственных и местных финансовых интересов. Рассмотрены финансовые интересы государства, связанные с формированием, распределением и использованием бюджетных фондов, которые реализуются на всех уровнях бюджетной системы в деятельности участников бюджетного процесса при осуществлении расходов из бюджета. Определены правовые средства обеспечения государственных финансовых интересов, которые зависят от объёмов бюджетних средств, целей и направленности бюджетного финансирования.
